Former President Hashim Thaci's defence team lawyer, Pierre-Richard Prosper, says the Special Court is criminalising the Kosovo Liberation Army.
When they speak of “joint criminal enterprise”, they speak clearly of the four accused who are there and then say “and members of the KLA”. They don't say some KLA members, but “KLA participants”, so what's going on here is that the organisation, which was responsible for the release of this state and this people, is now criminalising” said Prosper for the Rubik show.
Asked whether the Special Court is targeting Albanians only, Prosper said he cannot talk about motives, but the fact that the arrest of this court belongs only to Albanian ethnicity shows in which direction the court is heading.
We need to look at the facts here and what we're dealing with and the people that are here, in this court, are Albanian ethnicity, and the people who are in this court are people related to the KLA and I think that this in itself is an indication of what direction this court is going to be in.”
“We're continuing to do our job to investigate and build our defence, as discussed earlier, a part is challenged for the fact that we don't have all the information, the indictment remains edited, there are witnesses, for whom we don't know who they are, that the prosecution intends to bring, but as I said, the more we dive into the facts of this case, the more we talk about events, about incidents for this common criminal enterprise “, the more we believe in our case, the more we believe in our own.
Speaking of not including Dick Marty's report in the indictment, Prosper said this court is not fulfilling the goal for which it was established.
Therefore it is important that those who began this court pay attention and ask themselves how much this court meets the purpose for which it was established, because as you stressed, this court is based on Marty's report and there are no charges of organ trafficking in this charge, so we are here for all other reasons”, Prosper said.
