Rahovec Mayor Smajl Latifi has indicted Gjergj Goyani, leader of the Gjakova Education Inspectorate sector, for slander during the election campaign, and from the same is demanding 100,000 euros in damages.
This indictment, Latifi has filed since according to him, indictee Goyanni's actions have largely damaged his reputation, namely during the October 2021 local election campaign, creating perceptions and conviction in public, that the head of the Rahovec municipality has sealed the Education Inspector, reports “Betim for Justice”.
The indictment, provided by the “Justice Vow”, results in being brought to the Constitutional Court in Gjakova on 7 April 2022.
The indictment reportedly states that indictee Gerg Goyanni, in the quality of the education in Giakova (Inspector of Education), on September 21, 2021, had issued a decision with which (kins) he has filed violations and irregularities and violations of the law at the Law Directorate of Education in Rahovec and had made a decision requesting the start of the disciplinary procedure and the dismissal of Education Director Avni Morina.
In addition, the indictment reportedly has called the indictee and sought to clarify the contents of the verdict, because according to him, the same is illegal, does not enter the domain of the Education Inspectorate duties and responsibilities, making a decision on the request for the start of the disciplinary procedure, and the dismissal of the Director of Education.
In terms of the ruling, it is said that on the judicial basis and (against) the legality of the same, it has been decided on the second-instinent side, according to the complaint, where the decision issued by Inspector Goyanni has been cancelled.
While, according to the indictment following the conversation between plaintiff and indictee Goyanni, the latter on October 1st 2021 has submitted to the Constitutional Prosecutor in Gjakova, criminal proceedings against the plaintiffs, with the request for the launch of criminal procedure for criminal prosecution.
At the time of presentation, the indictment reportedly was the electoral campaign and this criminal outcry presented on the part of the indictees has been distributed by all local and national electronic newspapers, which for the plaintiff has been an unfair impact on the performance that he had on the basis of polling about expectations in municipal elections.
The prosecution is said to have markedly negatively influenced public opinion, as well as the surveys, while shortly after the publication of criminal gossip, there were numerous debates and online news, of all written and electronic media.
Always according to the indictment, such actions are said to have greatly damaged the good reputation of plaintiff, just during the election campaign, creating perception and conviction in public that the mayor has seized the education inspector.
While, with the decree of March 7th, 2022, criminal outcry has been cast, with which the indictee has been proven to have made criminal charges, in order only to damage the reputation (in the quality of the mayoral candidate) at the time of the election, for the plaintiff.
Hence, the plaintiff has filed a libel indictment, which he sought from indictee Goyanni, compensation for the damage in the amount of 100,000 euros, as well as procedural expenses.
