Kadri Wessel's lawyer: Serbian Secret Service Man Co-operated with Prosecutor and Offered False Evidence

A recent development has occurred in The Hague Specialised Chambers. Kadri Veselini's lawyer, Ben Emmerson, in a statement handed down to the Special Court, has handed over claims that a Serbian Secret Service person has collaborated with the Specialised Prosecutor, and has offered false testimony against Hashim Thaci and Kadri Weselin. It's all connected to files that were handed over to the offices of the War Veterans Organization two years ago. One witness was submitted to the Special Court, giving evidence that Hashim Thaci and Kadri Wessel were responsible for leaking documents from the prosecution.

However, according to Veselin's lawyer's statement, the same witness has withdrawn his statements, the doke claimed to have been urged by another person to lie, broadcast the Nacional newspaper.

“The protection provides that information pertaining to [ REDAKU] and [ REDECT] has been revealed for the purposes of investigating the authenticity of [the] claim. REDECT] that [ REDAKUED) has provided false evidence and to determine the true extent of efforts by Serbian state agents to improperly influence these procedures. To properly contextize the relevant” events, it is said at the beginning of the preview.

But how did everything happen?

In September 2020, files were sometimes handed over to OVL-KLA offices. An unknown witness has claimed those files were issued by Hashim Thaci and Kadri Wessel. However, this witness, along with the person who has prompted him to prove false, is linked to the Serbian Secret Service.

The person who had encouraged this witness to fabricate, whom the defence calls <x0informator”, according to the letter, had regular and direct contact with the Specialised Prosecutor's Office and with the Special Prosecutor.

In October 2022, a witness appeared to claim that Mr. Wessel and Mr. Thaci was responsible for the flow of documents that were at the centre of the Gucati and Haradinaj case near the Specialised Chambers of Kosovo”, said initially in the presentation of lawyer Emmerson.

This year, the witness withdrew his claims and claimed not only that he had lied but that he was also moved to lie by an informant who (i) had been in regular contact with the Special Prosecutor's Office; (ii) seems to be their contact point for a number of witnesses in the trial, and (ii) claims he had regular and direct contacts with the specialised Prosecutor<1>, says in the letter signed by British lawyer Benmerson.

The issue was also raised at the November 4 session. Wessel's lawyer has introduced that this person has deceived Wessel's Thach from a person who is also unknown to identity.

The “The most (readed), (readed) withdrew his previous statement, confessing that he was fed with information from a person named (read) who co-operates closely with both Serbian intelligence and the Special Prosecutor's Office”, says the letter of attorney Ben Emmerson.

Even in some transcripts of this person's interview, he confirms ties with Belgrade and talks about several meetings.

“Transcrypt makes it clear that (readed) has a relationship with the Serbian Secret Service. At a moment of the interview, he informed the Special Prosecutor's Office about his plans to travel to Belgrade (readed) where he would meet his source (readed) so that he would be able to provide more answers to the Special Prosecutor's Office”, the statement said.

“More (read) has given the second interview for the Specialised Prosecutor's Office (read) to confess that he was told what to say (read) in his statement by a man (readed) who was presented to the witness as (readed). The main interviewer in this case was the senior prosecutor (read)”, said in the published letter.

<x0) He explained that the Specialised Prosecutor's Office needed more facts to keep prisoners of the accused” further said in the letter.

This witness's claim was very harsh. He accused Thaci and Veselin of paying Serbian officials to get the prosecution's documents, to hand them over to the public later.

The center of a network of witnesses, which he had offered directly or indirectly to the Special Prosecutor's Office, appears to be the center of a network of witnesses. The defence has data on 15 contacts that (read) had with the Special Prosecutor's Office, which date back to (readed) 2017. According to the defence assessment, (readed) has raised claims and provided comments to more than 60 individuals during his talks with the Special Prosecutor's Office. In a routine, he has offered or claimed to put the Prosecutor's Office in touch with relevant persons for investigations”, said the defence layer.

Wessel's lawyer accuses the specialised Prosecutor of brokering with specific services that false evidence would be used against KLA leaders.

The charges made by (read) against (readed) in his second statement are extremely serious. At the heart of the apparent prosecution's case is a reliable mediator who has instructed a testimony to come up with lies, in which the prosecution has publicly supported and repeated at the expense of the accused. Such charges are potentially catastrophic for the integrity of the prosecution's case, taking into account the extension of contact with the Specialised Prosecutor's Office (read). Any ethical prosecutor would have understood immediately after receiving that second contact with (readed) which might have been the implications for his case and would have taken steps immediately to investigate the degree of contamination”, the letter said.

According to the defence statement, the interview of these two people proves that they are related to the Serbian Secret Service.

“Two interviews in [ REDOCTURE] makes it clear that [ REDAKU] and [ THE two have a relationship with Serbian intelligence. Interviews include references to: a meeting between [ REDAKU] and [ REDAKUED] in Belgrade where [ REDAKUED ] may receive more information for the Specialized Prosecutor [ REDAKUED] confirming his awareness that Serbia had rejected a request from the Prosecutor for documents belonging to Salih Mustaf; and (ii) a lunch followed by [the] REDECT], [ REDECT], and [ REDECT]”, said further.

The obvious concern this causes is that Serbia, through [ REDAKU] and [ REDAKUED], he has offered false testimony and evidence to the Prosecution. The risks this poses for the prosecution's case are grave, especially in view of the apparent extent of its reliance on information, leads and presentations offered by [the] REDECT]”, said further.
