Hysni Gucatt's defence and Nasim Haradinaj is not ready to close the case with the conclusion of the last witness's hearing, the lawyers of the two indictees currently being held in custody at The Hague have announced.
Gucatt's defence, Jonathan Elystan Rees, has said they will hand over the motion during the day regarding the process of extracting materials.
“The shield is not ready to close, there is a problem of extracting materials that were not selected, we have been given instructions to respond to the details of the deadline, and this is the fourth hour of today and we will answer it before 1600 as instructed, then we will have to wait on the trial panel. If ordered to extract these materials, then we will consider what further steps we will take, if the extraction is refused, then we will seek the right to appeal it, and consider the possibility to appeal it, at this stage we will not prejudge the outcome of this process, and we will expect what will be the decision to this controversy we have made on the issue of extraction”, the lawyer Rees said.
During the hearing at The Hague, he has said they are unable to predict today whether the defence issue could be closed with the conclusion of the last witness's hearing.
While the chairman of the court's shame, Charles Smith has said that they will be able to do so Monday when the conference on the course of the case is held.
Nasim Haradinaj's Hysni Gucati were arrested on 25 September 2020, since they are also staying in custody at The Hague.
