Haradinaj's lawyer: We'll follow legal ways to disqualify two special judges.

British lawyer Toby Cadman, accredited by the Special Court as part of the defense of the accused for criminalisation of obstructing justice administration, former head of OVL-KLA, Nasim Haradinaj, has indicated disappointment with the refusal to demand for “against the qualifications of two senior judges --” of the Special Court, for whom they are allegedly having [...]

Cadman, in an e-mail response to Express, has said they will explore further legal ways in compliance with the Constitution of Kosovo, recalling that the Specialised Chambers function under the jurisdiction of the Kosovo judiciary.

“All I can say at this stage is that we are disappointed with the decision [ananannounce of the lawyer's request for the dismissal of senior judges] and will consider further legal and constitutional ways of Kosovo's Specialised Chambers, as the Republic of Kosovo judicial body allows it to submit to the Express.

His response comes after the media article The Telegraph reported that British lawyers accredited at The Hague have sought the dismissal of Justice Speaker Ekterina Trendafilova, as well as Charles L. Smith, Vice Chairman of Specialized Rooms.

According to the daily, British one of the judges announced European diplomats on Haradinaj's case, violating independence and impartial judicial decision-making.

Meanwhile, for the second judge accused of overstepping the competencies, British lawyers are claiming to have compromised his independence by putting political pressure on other judges and suggesting that Brussels is pressuring them for sentences on alleged war crimes in Kosovo.

The Special Court, weeks ago, has scheduled the next hearings against the two KLA OVL officials, Hysni Gucati and Nasim Haradinaj. According to the announcement, the atrophy court hearings will be held on September 1st and September 2nd 2021.
