EULEX reaction comes following former Judge Malcolm Simmons's accusations

Former head of the EULEX Court of Judges, Malcolm Simmons, during a report before the Commission for Legislation, Mandate, Imune and Supervision of the Anti-Corruption Agency, said the mission EULEX was not a “mission of rule of law, but it was a political mission”. The plan stressed that EULEX was meant to get rid of the political scene, those to whom [...]

The plan stressed that EULEX was meant to remove from the political scene, those it described as a big <x0-weight”, or those who were seen by this mission, as an obstacle to Kosovo-Serbia dialogue.

To his statements, he has reacted EULEX.

According to them, Malcolm Simmons' statement given in the Parliament today is a collection of thoughtless and baseless speculations, lies, and personal thoughts.

The “Knowing that he cannot be charged with slander, since Simmons's statement is covered by immunity from parliamentary privilege he is involved in a deliberate dezinformation campaign concerning violations allegedly taking place during his time in EULEX and aimed at serving secret motives and interests. We see this as another attempt to discredit the Mission from those interested in undermining the rule of law in Kosovo as well as its EU. This is also a reflection of discontent not knowing that he cannot be indicted for slander, Mr. Simmons is engaged in a deliberate dezinive campaign regarding wrongdoing allegedly occurred during his time in EULEX, aimed at serving secret concrete motives”, it is said in response.

Knowing that he cannot be charged with slander, EULEX says Simmons is engaged in a deliberate disinforming campaign concerning alleged wrongdoings occur during his time in EULEX, which aims to serve concrete secret motives.

According to EULEX, during his statement, Simmons has agreed to have had contact with the third parties in the ongoing cases, which is a violation of fundamental judicial principles, viewing this as another attempt to discredit the mission and as a reflection of its total discontent in the outcome of three investigations that have been conducted against him by EU authorities in Brussels and that have been handed over to the delegateal authorities of the United Kingdom (MB) for further actions.

“Simmons also seemed dissatisfied with the rejection by the UK court of a civil indictment he filed against Mission and other EU institutions in 2020. In February, he is unhappy with all legal procedures against him”.

“Simmons was an employee delegated by the United Kingdom in EULEX since 2008 in several positions and almost through the entire EULEX executive mandate, which ended in June 2018. During this period, Simmons had been delegated by the Foreign and Commonwealth Office (ZJK). He no longer works for the ZPJK, but according to his statement Simmons, during his entire period in EULEX he had regularly reported to the UK authorities. He has today claimed that in 2013 he had presented his concerns to the UK Embassy, not to EULEX, the EU or Kosovo authorities. After that, not only has he not left EULEX, but in 2014 he has applied and has agreed to become head of EULEX judges. At the end of 2015, Simmons proudly declared that EULEX has been particularly effective in the types of cases it has dealt with. According to today's Simmons statement, in 2016 he had also applied to become head of Kosovo's Specialised Chambers, but that he had not been selected”.
