The argument of Kryeziu is that the Special Court is legally Kosovo's, but headquartered at The Hague.
“Judge Kai Ambos, in his opinion divided by the decision to refuse a parole request, explores the possibility that third states might in the future serve as possible guarantors for any accused. But Kosovo is not the third state, because the Court is legally Kosovo. Based on legal provisions, the guarantee is neither required by the mother state (Kosovo) nor by the prime minister of the mother state (the government of the Republic of Kosovo), from which the accused comes and whose state the Special Court belongs by jurisdiction. So Kosovo cannot serve as guarantor, as it is being reported. Special Court comparisons with international courts, as with The Hague Tribunal, are unstable, both in relation to courts themselves, one local and another international alike, in relation to persons/institutions who have been able to offer guarantees”, Kryeziu said of TIME.
