Article 162 of the Kosovo Constitution envisions that the Specialised Chambers have all the competencies and mandate needed to enable them to keep sentences outside Kosovo's territory by anyone convicted. In accordance with the Constitution, the Law for Specialised Chambers and the Office of Specialised Prosecutors and the Procedure and Evidence Order, the KSC president, after hearing the accused, will decide on which the Acuposed States will serve his sentence, choosing from a list of states that have agreed to accept convicted persons. This way of transferring special convicts, the Specialised Chambers Law and the Specialised Prosecutor's Office, adopted by the Assembly of Kosovo in 2015, is provided.

In accordance with international law and in accordance with international agreements, any person charged with crimes by specialised rooms could be detained and transferred to Specialised Chambers located outside Kosovo's territory. If convicted and sentenced to prison, these persons could be transferred to serve their sentence in a third state outside Kosovo's territory, in accordance with agreements reached under paragraph 4.

But besides Kosovo's recognition of justice, they estimate that eventually convicted by the Special, the sentence will not be able to suffer, even in the countries of the region.

Meanwhile, the executive director of the Kosovo Institute for Justice, Ehat Miftaraj, says that depending on the state where the convicted is decided, even the measure of condemnation is different.

Miftaraj says, the Kosovar side had made efforts to enable potential convicts to serve the sentence in Kosovo, but this was rejected without much debate.
