Such a proposal by lawyer Rekathat has been made again at the second review session, held Wednesday at the Constitutional Court in Prizren, reports “Justice Vow”. This review session was held for the second time, after the Court of Appeals had considered it based, the plea against the Constitutional Court's decision not to allow the conduct of psychiatric examination of accused Bajram Velia, so Appeal has demanded that the Constitutional Court reassess the case again.

In this review of the defendant's defence, lawyer Orhan Rakathatti again said he is close to claims that in carrying out this criminal act by his client, there has been no element of the will and stands close to the proposal for psychiatric examination.

The proposal for psychiatric examination, he relies on the accused's statement that at the moment of deprivation of the deceased's life, he has fired a bullet and then lost himself by being anxious and the other bullets have vanished into the body of the deceased, since in his opinion he did not know what he was doing and in his eyes a square black one has appeared and done this criminal act.

And another reason, according to him, that such a examination should be conducted is that the work his client is accused of envisions the sentence of life imprisonment, so it conditions it and charges the court with a psychiatric examination.

In the words of his defender, the accused Bajram Velija agreed.

Prosecutor Ervehe Gashi stated that from the defence attorney's statement, she has realised the same has not rejected the evidence on which the indictment is based.

Regarding the proposal for psychiatric examination, prosecutor Gashi stated that the defence is making such a proposal without introducing any material evidence which shows that sometimes in his life the accused has suffered some temporary or permanent psychiatric disorder or that the accused has an impulsive character, suffers from depression and has not proposed a single witness who shows that the accused had such conduct.

While the damaged side's representative, lawyer Ariant Koci, said that at this stage of procedure, criminal legislation does not presuppose the court to make a decision about announcing the safeguard clause for access to psychiatric disorders and that this could be taken in later stages of the procedure.

As for the element of Koci's will, lawyer Koci stated that at the moment the victim was leaving their home, the defendant was equipped with a pistol and shot 15 times in the direction of his wife, hitting the same 14 times in different parts of the body, he thus says that precision has been great for an individual with a reduced mental essence.

The damaged Sunza Hoti, who is the victim's daughter, claimed to be in total agreement with the words of her attorney and authorized lawyer.

During the hearing, the defendant returned from damaged Sunza Hoti saying that “you soon came here where I am because exactly the No.1, number 2, number 10, with a dead man, with a man in custody, is the sun.”

To this statement of the accused, the lawyer of the injured party, Arian Koci, who said he strongly opposes this defendant's statement because he, apart from the Sunse, has killed his mother, is now being attacked.

After having no further proposals, Justice Chairman Raima Elez announced that the second review is complete, while the next session was scheduled for November 03th 2020 at 09:00.

Otherwise, according to Prizren's Constitutional Prosecutor's Act, compiled on 28 February 2020, Bajram Velija is charged that on August 6th 2019, in the neighbourhood of “New Life” in Prizren, he deliberately deprived his family-wife, Amenda Aliu-Velija.

According to the indictment, after a preliminary disagreement with the victim, the moment the victim was leaving their home, the defendant is equipped with a pistol and fired 15 times toward his wife, striking him 14 times in different parts of the body. After carrying out this action, the defendant covers his wife in a dress and awaits the arrival of the police.

Bajram Velija is accused of committing the criminal act of serious murder.

According to the second point of the indictment, it is said that by August 6, 2020, the defendant holds in ownership and control of the type pistol “Pytro Beretta Gardone”, several caricators and bullets, contrary to the applicable Law regarding weapons, with which the prosecutor suspect the criminal act of the serious murder has been committed.

With these actions, the accused has, according to the indictment, committed the criminal work of ownership, control, or unauthorized possession of weapons.

Otherwise, defendant Velija has been in custody since 6 August last year.
