Sentenced to 14 years and 10 months in prison for grave murder in Lipjan

They are charged that, in February 2015, in the restaurant “Agon” in the village of “Banule”, following a dispute between them, in co-ordination had now deprived the late Urim Dushulofci of life, reports the “Bettim for Justice”.

According to the trial pronounced by the court's chairman, Judge Naim Krasniqi-Jashnica, accused Besnik Bedrolli of criminal activity “serious murder” has been sentenced to 11 years in prison, while for the criminal work of “arm kept in charge of” to a year and a half in prison. Thus, the same court has pronounced it a unique prison sentence of 12 years.

For accused Bajram Bedrol, the court has made redecorating the criminal offence from “serious murder” committed in co-ordination, in criminal work “the slight bodily execution”, at the harm of the Erroll Qyqalla and Skender Ademi.

“We have not found that Bajram Bedroll has committed the criminal offense of the 179 heavy murder, paragraph 1 concerning KPRK's paragraph 1.5, in co-ordination, by Article 31. In view of Article 360, the tribunal has found that the same was committed in the criminal act, “slight bodily exhumation”, from Article 188 paragraph 2 of KPRK, at the expense of the injured Erroll Qyqalla and Skender Ademi”, Judge Krasniqi-Jashnica said.

The accused Bajram Bedrol, for carrying out the criminal act “slight body extraction”, from Article 188, paragraph 2 of KPRK, has been pronounced a prison sentence of 2 years and 10 months.

Judge Krasniqi -Jashnica has announced that the court has decided against accused Bajram Bedrol to cease the detention measure, and that the same one be placed in freedom until the full might of this act.

As for accused Besnik Bedrol, the judge has said that he will continue his detention until the full might of this act, but no longer than the sentence pronounced.

The two defendants, Bedrol, have been charged with paying medical expenses as well, each apart from 500 euros in the name of the puzzle, and 50 euros for the funding for compensation of crime victims.

The representative of the damaged party has been instructed in civil disputes for the realisation of the legal property requirement.

The disgruntled side to this ruling is eligible to agree in the 15-day term from the day of receiving a copy of this act.

The Constitutional Court in Pristina on November 27th 2018, accused Besnik Bedrol of grave murder, had sentenced him to 14 years and 6 months in prison, while for illegal weapons, to 1 year imprisonment, the court had pronounced a unique sentence of 15 years in effective prison.

While accused Bajram Bedrolli, for help in carrying out the criminal act “serious murder”, had been sentenced to 9 years and 6 months in prison, while for illegal weapons had been sentenced to 1 year imprisonment, but this court had pronounced a unique sentence of 10 years in prison.

In the past year, however, the Court of Appeals had turned the case into retrial, cancelling the act of first - degree judgment.

Otherwise, according to the indictment set up on October 12, 2015, it is claimed that Besnik Bedrol and Bajram Bedrol, on February 14, 2015, at the restaurant “Agoni” in the village of Banulla in Lipjan after a dispute between them, in the joints, the late Urim Dushupulci was deprived of life.

According to the indictment, the same was originally fought and then attacked by the late Dushulovci and the injured Erroll Qyqalla and Skender Ademi by strong means, the late man had used his weapon to avoid the attack, but the defendant Besnik Bedrolli, with his gun about a meter nearby, fired four times and wounds taken, he died at the scene, while the defendants had fled the scene.

With these actions, the prosecution charges the accused with the criminal act of “serious murder” by Article 179 KPRK's and to “ownership, control or unauthorized possession of weapons” by Article 374 of KPRKU.
