The lack of war crimes committed by Serbian forces in Kosovo, based on the current Code of Criminal Procedure, is seen as almost impossible by Justice Minister Selim Selim Selimi.
The head of the MD in an interview said he has demanded that the Criminal Procedure Code be returned to Government, following two recommendations it has received from the Venice Commission.
He said that such as the Criminal Procedure Code has some obstacles that criminals hiding in Serbia cannot pursue.
I've requested that the Code of Criminal Procedure be returned to Government because we had two recommendations from Venice Commissions and insisted that the judgment clause indisposed to combine with the existing Law that the Parliament has made, and some barriers within it. I've met the Special Prosecutor and War Crimes Department”
“They have given their suggestions and I have also formed a group that has started working from today, such as the United States, which will be part of the discussion, the Ministry of Justice, and we will discuss the best ways to follow suit in absence. Such as there are some obstacles that we cannot pursue criminals hiding in Serbia”, Selimi added.
Selimi has said the way will be opened for Kosovo to make a special law, where it will enable civil union among the same genders.
We have forwarded the Civil Code, which is a new thing that has passed a step. It is possible that in the countries we have in the region, which are ahead of us in European integration, a special civil union law is allowed. It has been preserved what was earlier, but it opens the way for Kosovo to make a separate law that would enable civil union between the same genders. So the moment the Civil Code goes to the Parliament and is hoped to vote, we will immediately begin the work of the special law”.
Selimi has said the issue of vetoing has been widely discussed, and there have been different opinions that the minister is not in favour of this process. He stressed that the past commission has had extraordinary experts and the best lawyers in Kosovo, but such mechanism has been political and unilateral.
The venting issue has been widely discussed and there have been different opinions from what the minister is not wanting to veto. Whatever system we design alone is the most important thing for all law officials to sit at a” table.
The first of the justice, it has suggested it has also received support from justice institutions such as the Prosecutorial Council and the Judiciary Council to be part of a comprehensive system, EO reports.
So I have invited the Prosecutorial Council and the Judicial Council, the Prosecutor's Courts, the Police, and together they must come up with examples and concrete proposals”.
The past “Commission has had extraordinary experts and has the best lawyers in Kosovo, but I have considered such a mechanism political because it has been unilateral made by the minister without keying all hiseders. So I've met the last commission and I've expressed this vision and I've asked them to be part of this new commission that will be included”.
I understand how many people have resigned. Having seen the terms of reference not different from the previous commission, but the composition of this group will change. By correctness I have still left open the possibility that they will return to this inclusive group”.
