The involvement of new members in the task force for the Vetting Process coming from the judicial system and the prosecutorial one has prompted seven members of the group of independent experts to resign.
Ehat Miftaraj from the IKD in a proposal for Online Economy said the large involvement of officials from these two institutions conflicts with the original and initial idea.
The past “week as a working group we have accepted an email from the Ministry of Justice where we have announced that the April decision of this year will be met with a new decision in Government, which the decision will include a large number of other public officials including at least 10 new members of the group coming from the judicial system and the prosecutorial system”.
“... We have seen such an approach that conflicts with the original idea that has been the group of independent experts to draw up scenarios about the need for the self-preservation process in Kosovo, and in this direction the fulfillment of the group has lost the meaning for us to continue and be part of this group. In this direction the Government of Kosovo and the Ministry of Justice has the right to form working groups for the Vetting Process, but for us as a team of experts, we have estimated that it no longer means”.
Among other things, he has said that from these institutions, they have no clear position for an independent vetting process, so he says that given this stance it was pointless to participate in this processing group.
“With the new Justice Minister we've had a meeting and at the meeting was also the deputy prime minister where we talked about continuing the processing group and at that meeting Minister Selimi has mentioned the formation of a new group or the fulfillment of the decision with new members, and on the basis of that as a team of experts written in the letter, we have estimated that our current participation would have a negative effect with the fact that by taking on the basis that most judicial system and the prosecutorial system of at least those who are represented in the public appear to have no position to have a position of self-incing position, knowing that attitude would be understood to take part of this task force.
He has confirmed that the Judiciary and Prosecutorial Council have devalated the veting process, EO reports.
It is true that in 2009 we have had a veting process, which in 2020 is proving to have been failed by the fact that a large number of judges and prosecutors who had failed in the 2009 process have returned to the justice system, and this shows that the Judicial and Prosecutorial Council have devalated that process”.
Miftaraj has said he needs a veting process, because according to him, in local and international reports Kosovo has begun to be called a seized state where the judicial system is politicised.
And that needs a veto process, I believe it is clear by itself that Kosovo with local and international reports is beginning to be regarded as a seized state where the judicial system is politicised and this system is unable to provide justice where public confidence in this system is low and changing this situation can only be done through the process of self-presuming”.
Justice Minister Selimi has been declared in connection with the recent resignations made by members of the independent group for the veto process.
He has even said he will hold an opinion conference on Friday to show further details on the issue.
