PDK: Government again seriously violates Constitution and usurps power on behalf of pandemic

The Democratic Party of Kosovo is alarmed by the recent decision by the dismissed government, Kurti, who has chosen not to comply with the Constitutional Court's bias by taking a decision that makes the same violation that this court has voiced. We remember that the Court unanimously ruled that the decision of the fired government, of the date [...]
We remember that the Court unanimously ruled that the dismissed government's decision, dated 23 March 2020, constituted a serious violation of fundamental freedoms, clarifying that special laws for preventing and combating infectious diseases will by no means give the Ministry of Health and Government the right to limit constitutional rights and freedoms across the country.
Immediately after the Constitutional Court's entry into force, this outgoing Government has taken the same anti-unconstitutional decision to limit citizens' freedoms, while this can be done only with a special law issued by the Assembly of Kosovo.
This downloaded government has not only failed to take the right steps in time, but is continuing to take chaotic, unplanned and improvised action, seriously abusing the indigestion situation.
While citizens are respecting the advice of health professionals, the outgoing Government, driven by the panic of worsening the pandemic situation, without list, is continuing legal and constitutional violations.
It can never be allowed to manipulate this government with the fight against the Coronavirus to overcome its competencies and to ignore the Constitutional Court's act of judgment by recuring the violation of the Constitution.
What makes the situation even more serious is that while it is successively violating the Kosovo Constitution, this government is also threatening the country's sovereignty and territorial integrity, allowing the extension of Serbia's state jurisdiction in the north through the silent adoption of Belgrade's emergency measures and allowing the introduction and action of its state officials in Kosovo.
This is an irresponsible and unprecedented behaviour, which shows that this Government is trying to get all powers out of the Kosovo Assembly function and focus on its own hands. The newly elected decision by the fired government constitutes a serious violation of the Kosovo Constitution, so the Democratic Party of Kosovo strongly condemns it and calls on other state institutions and all public opinion to engage in defence of the rule of law and to prevent authoritarianism in Kosovo.
Measures that must be taken for the successful combat and sustainability of pandemic should be in accordance with the country's laws and Constitution. No one can undo the constitutional order of our state, and much less those that to cover up their failures, have consistently brought against-law and anti-unconstitutional decisions.
