Kosovo towards new elections or interim government

At the time when the state has declared a state of emergency in the health sector due to the spread of the Coronavirus, the ruling coalition is heading towards partition. The Democratic League of Kosovo has decided to initiate no-confidence motion to overthrow the Kurti government, with the reason the prime minister risks undermining relations with the United States due to [...]

Constitutional recognitions show what can happen if the motion is voted in the Assembly, meanwhile stressing that the two ruling parties have made urgent decisions in time of crisis for the country.

Constitutional law professor Mazbul Baraliu explains the next steps if LDK's motion to oust government Kurti passes to the Kosovo Assembly.

At first, at least 40 signatures must be collected for his life, then the voting session should be called no later than five days after the signatures were delivered.

But Baraliu says the Assembly currently does not have even the basic conditions to develop works, taking into account the condition created by coronarys.

“If the motion is voted, the government falls, then the president of the country is forced to announce a state of emergency, if it does not find any other solution, it can try to seek out some political formation or political governing coalition potential to make a technical government, or to call political parties, the third possible solution possible solution, the possible solution to call the political subjects in the conversation, and to listen to find a general consensus solution in order to have a transition period, necessary in this situation to overcome the virus that we have reached a situation to achieve a stable state where the elections can be reached and explained by Bariquel.

He adds that political agreements should then get the Parliament's approval. If a governing formation is voted there, and it gains legitimacy and acts as long as political subjects agree, in order to find a transitional solution until conditions for new elections are created.

Baraliu, who is one of the founders of the Kosovo Constitution, says the solution should be made in the constitutional spirit, not violated as has happened not rarely by Kosovo politicians.

But under these circumstances, the only solution he sees is to withdraw the no-confidence motion from the LDK, and continue the work of this government until the crisis with the pandemic is over.

“Sometimes before citizens there is no excuse, I think it would be something that would have to erode the conscience of the two political subjects, even the probably hasty action at this time, at this time, at the time when we talk about the time of the crisis facing a global pandemic, that risks every citizen of the world and citizen of Kosovo, the hasty decision with the interior minister's dismissal, to reflect both sides and continue, to withdraw the motion, because it is the decision of the leadership that, if it continues to the end, it should also be LDK's also aware that there will be problems within the unique ideas and that are not unique, he says.

While political analyst Faton Abdullahu says the ruling coalition has not given signs that it is stable since the beginning.

The “given what is the current situation is not fair in front of the citizens of Kosovo all of what is happening in the Kurti government, is the government that has caused an extraordinary amount of circumstances that were worrying us all, because by dealing with issues that are based on tribal, party and other interests of this nature, institutions that should be dictated by the current government are blunted by the tendency to do business properly with the safety of citizens”, Abdullah says.

If the motion passes to the Kosovo Assembly, Abdullah says decisions should be made based on the current situation created by the coronary.

I consider that both, even going to the elections, of creating a sweeping government must be taken into account but always not forgetting the first one that is urgent and that needs to be answered at any cost today is right now that it's the coronary” he adds.

Disagreement between coalition partners was highlighted with the issue of the fee against Serbian goods, which Prime Minister Albin Kurti said would partially remove to replace it with reciprocity.

Meanwhile, the LDK, following continued pressure, of Kosovo allies, particularly the United States of America, for immediate and unconditional removal of the tax, warned Kurti that it would suspend its rule.

Problems between them were deepened when Kosovo President Hashim Thaci proposed to «a state of emergency was declared at the country level, something the prime minister rejected, but not the interior minister. Agim Veliu of the LDK, was dismissed from the post of interior minister since the same stated that the state of emergency should be declared in the country due to pandemic, arguing that it has spread panic.

Last night, LDK leadership decided to initiate no-confidence motion for the collapse of the Kurti government, a motion that has so far received the support of the Alliance for the Future of Kosovo and the Socaildecrates.
