What the Constitution says about ambassadors, who decides President or Government

Foreign Affairs and Diaspora Minister Glauk Konjufca has proposed withdrawing 7 ambassadors from Kosovo diplomatic missions.

On Konjufca's decision, he writes that based on the Kosovo Constitution, the Law for Foreign Service and the Law for the Ministry of Foreign Affairs has called for the withdrawal of these ambassadors, as he has called them political.

However, Foreign Minister Glauk Konjufca cannot dismiss ambassadors from office without even the decision of the president of state, in this case Hashim Thaci.

Based on the competencies the president gives to the country's Constitution, it is only him who dismisss and appoints Kosovo state ambassadors.

According to Article 88, pikur 25 of the Kosovo Constitution, the president has the right to dismiss and appoint all chiefs of diplomatic missions with the government's proposal.

“Names and dismisss the heads of diplomatic missions of the Republic of Kosovo, with the government's proposal”, said in the Constitution.

The diplomatic mission, it is said, is the president who makes final decisions.

“The president of the Republic of Kosovo orders the withdrawal of an ambassador or mission chief from the diplomatic mission before the deadline ends, for the following reasons: 1.1. for work needs at the Ministry of Foreign Affairs; 1.2. based on the request of the diplomatic representative himself; 1.3. for negative assessment of the work of diplomatic representative; 1.4. for violating the provisions of this law or other legal and illegal acts in power; 1.5. When such a thing is required by the receptive state”, it is stated in law.

Foreign Affairs and Diaspore Minister Glauk Konjufa, shortly after coming to the helm of Kosovo diplomacy, has dismissed 14 Kosovo councils who were nominated to last term by former Kosovo diplomat Behgjet Pacolli.

However, Foreign Affairs Minister Glauk Konjufca appears not to have dared to propose the withdrawal of any of the LDK ambassadors who are nominated political.
