The property process warned by the Kosovo government is seen as the biggest challenge of this government and the Ministry of Justice. These two institutions, except that they must ensure a transparent and comprehensive process, should see that the justice system does not go without judges and prosecutors.

In addition, these organisations point out that the Ministry of Justice, along with the property process, has to do the recruiting of new judges and prosecutors, and this is preceded by the Ministry of Justice.

The director of the Group for Jury and Political Studies, Arbeen Loja, for Kosova Prees, says it is necessary that Kosovo create a property process, which would include all senior justice system officials.

She says the property process should be transparent, inclusive and have full support from all over the political spectrum. Loxha says the property should not happen just once, but must be a continuous process.

“We consider that this process should be done with the greatest care, with the greatest involvement of all relevant acts, with the design and implementation of the best known or best expertise and in the best possible way possible. In order not to end up being a process or a reform that is initiated and there is no concrete result in the end. So it should be done with the greatest care and respect for all principles regulated by laws or better standards, so that the process can start and end in the best way possible and at the same time ensure continuation, so that it is a process that continues”, she says.

Loja points out that it is important that this process be organised in a way that prevents the country from remaining without a judge and prosecutor. It cites the property case in Albania, where it has faced lack of prosecutors and judges.

I can't judge now what the epilog of the property process will be, but it's the main thing to draw up in the best way possible and implement the best. Then, it would have to be gradual to avoid going to the extreme or irregularities that have conveyed the property to Albania. We've always raised this as a concern, so it needs to be designed in a way that prevents the case as it has been the case with Albania to remain for a certain period of court or prosecutors”, Loxha says.

Veting in the justice system calls good news Kosovo Institute for Justice Executive Director Ehat Miftaraj, who says the property process is the only way to clear the justice system of non-competent persons and people associated with interest groups and politics.

Miftaraj adds that Kosovo has the unique opportunity to learn from the mistakes made in the property process in Albania and other countries.

According to him, with the beginning of the profiling process, there should also be recruiting for judges and prosecutors so that there is no shortage of them if they fail to pass this process.

Kosovo does not need to start a proficiency process immediately for all judges and prosecutors. It would be best to take place in phases and start with the Supreme Court, the Office of the Chief State Prosecutor. The second phase will then continue with the second steps of the Judiciary and Prosecutorial System and then at the lowest level, the Courts and Basic Prosecutors. And so, The IKD has proposed that in addition to the property process, the announcement of positions for judges and new prosecutors and before applying tou bêu «clearly that they will only assume these positions if current judges and current prosecutors fail to pass the property process, Miftaraj says.

He claims the property process should become a scale-scale, which would first include high positions.

Miftaraj points out that property in the entire justice system can be completed within seven years.

If this government is lucky to complete the four-year mandate, it would be a great success if the Judiciary Council, the Prosecutorial Council, the Court of Appeals, the Office of the Chief State and the Supreme Court complete the property process within four years. So this first phase should start with the highest positions. The moment Kosovo has an independent Supreme Court of Integrity, Professional, the same is true of the State Chief Prosecutor's Office, the Court of Appeals, the Appeals Prosecution, and the most necessary for the Judiciary and Prosecutorial Council, then we can say that the system will start to breathe freely, implement justice and citizens take law-based services. Then in the second phase, to continue with the Constitutional Court, the Founding Prosecutors, so that we can say within six or seven years this whole process can be rounded up and have a system based on what the Constitution and the law foresees.

The property process, Justice Minister Albulen Haxhiu, is considering the biggest challenge facing the Government of Kosovo and the dictatorship it leads.

Haxhiu for Kosova Press, stresses that the property process will go along with the Kosovo Assembly, where he says they will try to do it with my constitutional change, but if they fail they will go through the law on property.

I've said that this process could take an Oriental to a 24-month term, because I believe that within this term we can address at least constitutional changes, legal changes. And then to set up relevant commissions for verification, especially for the highest hierarchical levels in this case for prosecutorial and judicial councils, chief state prosecutor, chief prosecutor, court heads. So when we manage to verify the highest levels of the justice system then much easier is to get this through to other institutions”, she says.

The first of the justice points out that they have seen a lack of prosecutors and judges being recruited along with the property site.

“We have the alternative for this, equal to the vetting process we have planned to open even free recruiting positions on condition that prosecutors who were elected will be replaced only in the case any prosecutor leaves because he fails to pass the verification. We have received this for the fact that something has been happening in Albania that the institutions without representatives remain, that means without judges, we have had a long time in the Constitutional Court. I have followed the property process in Albania, I think we should take the lessons of one of them is , just not to leave the system without prosecutors and judges, we have planned that equals the verification of judges, prosecutors, policemen will also be a recruiting process for prosecutors and judges on condition that they replace positions that remain without prosecutors and judges”, says Minister Haxhiu.

The Kosovo government, led by Albin Kurti, as a priority has presented property to police, prosecutor, judiciary, AKI, ATK, Customs and Financial Intelligence Unit will be a priority.
