Consul downloaded from Konjufca: I have not been appointed illegal, here's the facts.

Ashef Haxhiu, the consul who was dismissed yesterday by Minister Glauk Konjufca, who served at the Embassy of the Republic of Kosovo in Doha in Qatar, has reacted to that decision.

He says he has not been illegally appointed to this position, as well as counting a series of violations that, according to Mr. Conjufca publishing the names and locations of downloaded consoles.

Public clarification!

It is neither principled, ethical, nor professional, maybe even legal, that diplomats communicate to public channels certain legal and political disputes. Despite that, however, the first of our diplomacy, Mr. Glauk Konjufca, yesterday on Thursday, set a precedent like this, publishing the data of the 14 consoles downloaded from him, including my identity and location. He did this first in his personal Facebook account, which then spread to the media. I don't know if the Minister is aware that by doing so he has committed violations of Law No. 06/L-082 of the Republic of Kosovo for the protection of personal data, as well as violation of the European Parliament's 2016/679 regulation for the protection of general data.

In addition, public communication of the decision on his part is also contrary to Law No. 02/ L-65 against slander and insult. That's because, Minister, because of his position, I had to know that the reasonableness of his decision is based on a lie.

So I want to explain, argue, and document this.

  1. His decision to abolish my name decision as Consul at the Embassy of the Republic of Kosovo in Doha has been based on Article 20 of Law No. 03-L-22 for Foreign Service of the Republic of Kosovo. So look, doc. No. 01. Article 20 of this law specifically says: “Access to foreign service is done through open competition, in accordance with the Law for the Ministry of Foreign Affairs and the Diplomatic Service and the legislation in force”. So look, doc. No. 02.
  2. So, the Minister's decision, Mr. President. Konjufca, claims I have been admitted to foreign service without competition and contrary to this law. That's not true. The Ministry of Foreign Affairs has opened its public competition for the admission of 15 new diplomas by 1203.2019. So look, doc. No. 03. I have submitted to that competition where, after the first phase of documentation-based selection, there were three more stages of testing and value. These estimates are organised and implemented by the competent bodies of the state of Kosovo. For example, the second phase of written testing was organised and monitored by Kosovo Security Force authorities at their main centre in Pristina in May 2019.
  3. After a successful crossing of each phase, the MPJ staff office has invited me to submit to the latest value phase of the final interview. This interview was conducted at 05.06,2019 at 2:45 at the Foreign Affairs Ministry facility. So look, doc. No. 04. The interview panel has been composed of five Ministry officials whose names I do not remember.
  4. After the completion of this process, the MPJ Secretary General's Office has sent me the foreign minister's decision at the time, Mr. Behgjet Pacolli, for my appointment as Consul of the Republic of Kosovo in the state of Qatar. So look, doc. No. 05. It is noteworthy that the then foreign affairs minister, Mr. Behgjet Pacolli, my appointment, has, among other things, done by referring to the competition mentioned above. So look, doc. No. 06.
  5. Besides me, this decision was also sent to the RKS Embassy in Doha, where the Qatar authorities have later given their preference for my accreditment as a diplomat in Doha. In the meantime, the Consumer Department in MPJ has released my diplomatic passport, as well as later, in full co-ordination with all responsible instances in the MPJ I have made other arrangements to function my commitment as diplomat. So throughout the process I've been in complete communication and co-ordination with all relevant authorities and offices in the Ministry of Foreign Affairs. It is not that a single office or individual within the Ministry has accomplished this job. So in this process all relevant instances within the Ministry of Foreign Affairs have been involved. So, if any of these institutions have eventually committed any violations during procedures, then measures should be taken against them, not against me.
  6. Last but not least, I want to let it know that because of my commitment to the Ministry of Foreign Affairs, in the summer of last year I have resigned from two jobs I held at the time, one as a psychologist at the Ministry of Health and the other as a coach at the IOM. So look, doc. No. 07. Also, with the reason that I was named diplomat of the Republic of Kosovo in Doha, at the same time, I have refused the next offer by the German GIZ for a profitable professional commitment. So look at that, Doc 08.

So I never thought and never believed my name was illegal. Otherwise, it would be senseless to abandon three sure opportunities for a single uncertain possibility. So I expect the Ministry of Foreign Affairs and Diaspora to clarify this mistake, as well as to take the necessary steps to repair the moral, professional, material, public, legal and human damage that has been caused to me.
