EU Office in Kosovo chief Tomáš Szunyog has said that Kosovo and Serbia should make constitutional changes when signing international agreements. He made these comments during his report to the Kosovo Parliament's European Integrity Commission.
“As for Lajcak, I don't mind that when you negotiate international agreements then they are binding agreements and they become legally binding, so these agreements that you signed then you have to change some internal procedures and both countries have to make some constitutional changes because you signed legally binding agreements”, he said, when asked by VV deputy Gazmendpica for Lajcak's statement.
Szunyog has said it is up to Kosovo to establish the Association of Serb majority municipalities, and that the two countries in the future will have to make constitutional changes because of international agreements they have signed.
I know very well that there are agreements since 2013, and the next agreement is 2015, and a Constitutional Court decision and this ruling in no way prevents the creation of association only set limits regarding the 2015 agreement at the end of the decision said that the status of association should be sent back to the Constitutional Court. My question in this case is what is status?
According to him, international agreements are legally binding.
“In the progress report, no progress has been made in this area as regards the establishment of Association. It's up to you to do that, you signed and ratified these agreements with 2/3 in the Assembly, so it's not just an international obligation, and no one's pushing you to do something with your understatement, Szunyog said.
Szunyog presented the report to members of this commission, where he said Kosovo has noted little progress in many areas.
“Raport makes an assessment to the countries of the region and parks how the EU sees the region, where EU members then make their assessment. E Ismet Beqiri spoke of the Association Agreement. He said this agreement has been signed by both sides, including the key point where the Association should be in line with the Constitutional Court.
“Fulfilling these criteria must be done with full co-ordination with all political acts. It's true that we've taken a vow to Association. The Serbian side has also agreed that the Association should be in line with the Constitutional Court, which the Constitutional Court's response we already know, from this agreement has been violated the Constitution in 23 articles”, Beqiri said.
And Vetevendosje Movement MP Gazmend Grandpanka asked for statements by the special emissary for Kosovo-Serbia dialogue Miroslav Lajcak, who has stated that after the final agreement, the Constitution could be changed.
