Witnessing how the doctor in Gjakova had insisted on setting up his mother's coat without need

Witness Ukhshin Kelmendi has stated that after his brother had sent his mother for medical examinations at the Gjakova Regional Hospital, doctor Luan Pazhari had told her that she has only six hours of life.
Such a statement was said by witness Kelmendi, during his testimony Friday at the Foundation Court in Pristina, in the case known as “Stanta 2”, where 41 Kosovo public hospital doctors are being tried for corruption, writes the Votimy for Justice.
Initially, witness Kelmendi said his mother had had several health problems, sometime between 2011 and 2013, for which she had been sent to a Family Medicine Center in Gjakova.
A few days after this checkup, the witness said his brother had called him and had told him that his mother had only about six hours left.
These words, according to the witness, had already been spoken to his brother, the accused man, Luan Pazhar, and had repeated the same words to him and to his other family.
According to the witness, doctors had told him that his mother had had a heart attack on what they had not been aware of during her control at the Family Medicine Center. According to the witness doctor, he had been told that his mother's standards should be placed.
When from the prosecutor of the case, Florije Salihu-Shali was asked whether they had told him where to put these stations, the witness replied that he doesn't know exactly, only that he said they had prepared the ambulance, but he lacked the money, respectively, 5,000 euros, as much as he was told would cost such a service.
This money, the witness said he asked for it from his brother. According to Kelmendi, he had worked for several years at a clinic in Germany, and after seeing the therapy for his mother, he had told the witness to take his mother and send her home because there is nothing.
I asked for money from the brother who's outside, and the brother asked for therapy because he worked there at a clinic in Germany, and he told me that there's nothing to be done with”, the witness said.
In spite of that, the witness said he had again asked a colleague of Dr. Pajar to do his mother's checks, and when he had gone after 4-5 hours to get the new tests that had been done, the doctor whose witness did not want to mention his name told him that his mother's condition was not the one the doctor told him.
So this doctor, he said, had told the witness to take his mother away and send her home without noticing his colleagues.
When he gave me the results it was the greatest joy we were and I went to the house, but my mother didn't accept that result, and I was afraid to tell him if this was telling the doctors, and here's the victim who told me to take my mother out of the hospital. Prosecutor Shamlli asked the witness about the results of the doctor's tests the witness did not want to reveal his identity with the witness who responded, saying that the doctor told him that his mother had an attack much earlier but that it is not dangerous now.
After the head of the court, Shadije Grguri asked the witness who had allocated the 5,000-euro sum per stenta, the witness replied that such information had been obtained by the accused Pazhari.
After the doctor's insistences on not drawing his mother from the hospital, the witness said that he had agreed to go with the same doctor at a private clinic to make a recording, which he said cost her 150 or 250 euros.
This money, the witness said that he had given the accused Pajar in hand and had not accepted any testimony from them.
And then I went back to Dr. Luan Pazhar, by car to a private hospital that's somewhere outside of Gjakova. I don't know what machine bo, choreography or what, but I know I paid 150 or 250 euros, I don't remember. The doctor at the moment he checked it, said he's not normal with a heart attack and don't cause heart injury. Then I took her home and sent her to the house”, the witness said.
On the other hand, the witness said that two or three months before his mother's case occurred, similar problems had occurred to his aunt.
And why it's come to this, I know exactly, because 2-3 months ago I've been with my aunt, the Lion, and this man said that my aunt has bad heart jobs and told me that 800 euros cost me a recording and I'm in a coma that I don't handle that much, so he said 250-300 euros. The late Uncle, he sent me money from Germany, and when I got there, my aunt's boys talked to The Lion and then they got their aunt out with nothing. Because he had no need for the stenta at all, the witness said that he had experienced another doctor, Zeqe Red, in whom he had taken another check on some recent problems his mother had had had with him.
According to the witness, when he had told the Red doctor that his mother had wanted to set up stables, the same man had told him that his mother does not have blood vessels narrowed down and that she does not need seasons.
The witness also said that last November had taken a photograph of his mother at the Gjakova Regional Hospital, where, according to him, his mother was shown to be in need of heart narrowness, not expansion.
Responding to the defendant's questions, lawyer Korab Bocshi said he did not remember whether he had offered material evidence to the prosecutor during his testimony there, while acknowledging that he had accepted paper with the case of his mother leaving the hospital, but the same one said he did not have it with him at the hearing.
After the accused said he felt hurt and said “Luan Pazhari has a terror in his family”, lawyer Bocshi asked the witness why he has not filed a lawsuit because he feels hurt.

For this testimony to Kelmendi, lawyer Bocshi said there is remarks, as he says the testimony has been confusing and has behind the contradiction in his statements.
“Do you have evidence of the payment you said you paid 250 euros?” the defendant asked the witness, with the latter saying there was no payment testimony, but the money was delivered.

After accused Gani Bajraktari asked the witness whether it was the same interest as to how it is possible to set the stage without making the choreography, the witness responded by saying that “the Lion”.
Responding to the questions of Judge Shashivar Hoti, the witness said that this doctor, who is not willing to reveal his identity, works at the Gjakova Regional Hospital and that the tests he had done to his mother, had been the same as the physician Pazari had done, but the results were different.
When you took your mother, with what basis did you take her to the photo shoot when the results said they didn't need her?

And the accused Pazhar asked that all persons who were listed be invited as witnesses.
Before witness Kelmendi was heard, another witness, Zeqiri Maxhuni, was presented to the court, but since the same said health problems had taken place in 2007 2009 prosecutor Shamlli said she withdrew from the proposal for this witness's hearing, as that period of time is not included in the indictment.
Otherwise, in the “case Stanta 2”, 45 doctors were involved, but due to health reasons, procedures for accused Ferid Susuri, Murat Abazi and Ferihane Sefa were set aside during previous sessions.

These charged were found innocent in connection with charges charged by the Special Prosecutor of the Republic of Kosovo (PSRK), in the initial review that was held on the case in February 2018.
In this case, included were former Health Minister (MSH) Ferid Agani, former MSH Secretary Gani Shabani and 11 other indictees, but the case was isolated in three parts in the initial review.
Former Prime Minister Agan and former Secretary Shaban were convicted in April 2019, with Cyrast Agani sentenced to two years and six months in effective prison, while Shaban was sentenced to two years in effective prison. After the defenders' complaints, however, the case has already been turned into a retrial by the Court of Appeals.
In contrast, judicial process in case “Stanta 3”, where they are mainly involved, directors of private hospital doctors are expected to begin soon, as the indictment against them has been confirmed by two judicial instances.
Indictees in “case Stanta 2”, charged by PSRK with criminal acts of abuse of official position or authority and bribery.
According to the SPKR indictment, there is well-founded doubt that from January 1st 2011 to December 31, 2015, acting in co-ordination from the position of doctors at USKKKUK, they have misused their official positions and authority, in a way that by overstepping their competencies as members of the Cardiology Clinic Consiliar Commissions, knowingly and knowingly have issued reference letters for treatment outside public health institutions of at least 233 persons, even though the same had conducted medical treatments.
According to the indictment, this was done to allow people in question to compensate for expenses from the Ministry of Health, for medical treatment in private institutions, even though, as the indictment says, on the basis of Article 53 of the Law on Health, No,2004/04, February 19, 2014, and Article 16 and 25 of the Law on Health No.04/L-125 of December 13, 2012, the reference letters had to be issued to patients at the moment when it found that patients were unable to be treated within the public system.
With these actions of the accused, The SPKR claims the damage caused to Kosovo's budget is 4,555,553.00 euros.
Also, the indictment charges doctors to “case Stanta 2”, that they have misused the official position and taken bribes, so that instead of patients who have gone to public health institutions, they refer to the competent invasive unit at the USKKKU Clinic in Pristina, patients have referred to them in private hospitals, and for these actions have been bribed.
According to the indictment, each patient they sent for the stents received a bribe of 500 euros, while the choreographer received 150 euros in bribes.
These actions, according to the PSRK, had been carried out in co-operation with the accused who are already involved in the “case. Stanta 3”, which is mainly the owner of private hospital doctors.
The State Prosecutor on June 15th 2016 had filed charges against former Health Minister Ferid Agani, former MS Secretary General Gani Shaban and 62 other people for criminal acts “the mismanagement of official position or authority”, “bribe taking”, “bribery”, <6> irresponsible medical treatment”, “The legal offense against legal activity, and <x-8>>
Meanwhile, the prosecution had resigned from prosecution against cardiologist Africa Bekteshi, arguing that the same was wrongly involved in the indictment.
In this criminal case, investigations were initially conducted against 116 physical persons and 4 legal persons. But for 56 physical persons, no legal conditions have been met to be included in this indictment, so the same investigations have ceased.
The defense of the accused has raised numerous dilemmas about the legality of this indictment, which they claim, in addition to containing unacceptable evidence it has been illegally raised by chief state prosecutor Besim Kelmendi. According to the defence, the State Chief Prosecutor's Office has no competencies in establishing the charges, as has happened in this case.
