SBASK is expected to submit petition regarding the law on salaries to Constitution

In the case of the provisional suspension of the Constitutional Court's Law under the request of the ombudsman, which will be suspended until March 30th this year, there were many reactions and frustrations from unions of some public institutions.

Prompt reactions were made by the United Trade Union of Education, Science and Culture of Kosovo, which began through signing a petition against the decision to suspend the wage law, and with these signatures would address the Government in office and the ombudsman.

The chairman of the United Trade Union for Education, Science and Culture, Nundman Jashari, says the petition signatures against the decision to suspend the Law of Pays are being collected and that most municipalities have delivered it. They seek the ombudsman, who on behalf of all those thousands of signatures, addressed the constitution to suspend it, more accurately cancel the decision it has adopted to suspend the wage law by the end of March, because according to him, it is considered very long.

“There was serious trouble and concern, in the case of suspending the constitutional wage law. We talked to our members and they probably, because he was aware of the situation, we had a spontaneous idea to collect the signatures and go to the Government on duty, and the ombudsman, that, as he did with the complaints he had 35, to act the same as our complaints, since we are our people, he is our attorney, with the request that he is addressed in the name of all those thousands of signatures, the constitution to suspend him consciously, to reverse the decision he has made to suspend the wage law by the end of March, because we consider that it is a long term, and that I say, the constitutional education sector is not going to be certain. The signatures are being collected, most of the widow's municipalities have handed over”, says Jashar.

Jashar stressed that there are “pro” implementation of the wage law and that if the law is turned to zero we will have very big trouble.

Ombudsman Hilmi Jashari said he has accepted the SBASK's request for a change against the temporary decision to suspend the wage law.

“It is a requirement that has been submitted to us, with the signing of the petition coming from the Education Union, and from which it is required that we as the ombudsman's institution forward to the Constitutional Court this requirement for change and provisional measures, yet it is a request that has been submitted to us, and according to a legal mandate that we have the same thing we can forward to the Constitutional Court, and now we are alone in preparation to escort it to the Constitutional Court, yet this has not held back at any moment the Education Union as the third party directly to the Constitutional Court, it is not a problem that should be conveyed to the Constitutional Court, of course, the Constitutional Court, of course, it is, the Constitutional Commission, Ya1) said.

According to Jashar, we should give space to the Constitutional Court to make the right decision in this matter.

While, Haki Shatri, adviser to incumbent Prime Minister Ramush Haradinaj, through a call, told Kosovo that the role of the government in office at this stage of developments has no effect. According to him, the Government has completed this process, and this issue has gone into other justice-related institutions and has now passed to the Constitutional Court. According to Schitr, organising interest groups has been known because someone is under the law of someone not, but that the incumbent government cannot make a decision on Constitutional Court decisions.

He added that the law should be finalised as soon as possible because all preparations for implementation of the law have been in order, both budget and salary lists and all necessary procedures.

Shatri stressed that they have taken care that even if the wage law is not implemented, do not prevent the old form of salary prosecution from harming citizens.

SBASK Chairman Nakman Jasharaj, FSSHK's Blerim Syla and SPK head Valbona Kamberi, days ago also met with Kosovo Parliament Speaker Glauk Konjufca, where prior to him they have expressed their concerns on behalf of the thousands of members representing that after the disappointment that took place regarding the wage law, if there is no budget law and payment proceedings, then the situation will be too tense and there can be different reactions.

Konjufca at this meeting has told unionists that he has been considering with experts the eventual possibilities for Kosovo to have the budget law for 2020, not to come to the situation of the paid waste of thousands of employees in different sectors, but in the current situation, without the new government, the chances of having a budget law are small. He has indicated he will make all commitments that in co-operation with all other parties find a legally allowed solution.

Otherwise, the decision on the provisional suspension of the wage law has been taken by the Constitutional Court at the request of the ombudsman, following 35 complaints for this law in length until 30 March 2020.
