Pristina municipality clears up about planned construction at Badoci

The Pristina municipality has clarified and published some documents regarding construction in the vicinity of Badovci, as it says in order to avoid deliberate and deliberate misinterpretations:

These are the explanations:

1. In September 2017 the panel applied for construction conditions on private property in the vicinity of Badovci. Most of it is out of the Lake Zone II. 2. The side has complained to the second degree at the Ministry of Environment and Spatial Planning, and the ministry has made a decision where it has accepted the side's complaint and obliged the Pristina Community to act on the decision. Attach in the photo.
3. In February 2019, the Pristina municipality has also issued a Refutive Decision for Construction Conditions based largely on the government's 2013 decision on water protection. Attach!
4. The side has complained again to the second degree in the ministry. The ministry has given the side the right and imposed the municipality for specific parcels to act sips P. ZHK and the 2013 government's decision to seek environmental consent, because Zone II is not the area of strict regime and these are not tourist or dangerous objects, and that the ministry makes environmental assessment when it has applications. 5. On the basis of the second degree decision, the municipality issues conditions, but under the Ministry's decision in three paragraphs that conditions do not apply without the Ministry's Environmental Review as part of the 2013 decision, and that the side cannot apply for permission without ensuring prior consent or environmental permission from the Ministry of Environment and Spatial Planning. So, the side has no permission, conditions are not permits, and the side has yet to apply for permission or environmental consent to the ministry. So once again, we're talking about private property which by the time it was bought was meant for sustainable construction. Only part of this land is in Zone II where environmental consent is needed by the Ministry. The side by law has the right to seek its rights according to the law. The Municipal Development Plan has been in force since 2013.

The municipality has twice rejected the decision on conditions in two different years based on the government's decision to protect the waters. The ministry as the second degree twice after legal estimates has given the lie that in Zone II, it is not the strict regime, and the mission decides whether appropriate measures have been taken to protect the lake.

Even during the release of conditions, it has been indicated that it cannot be applied for permission without obtaining prior consent from the Ministry on the basis of the 2013 Water Protection decision. So conditions are not valid without such consent. According to our information the company that has introduced the solution has not yet applied to the Ministry of Environment for Environmental Education.

So protection is done according to all legal norms from all institutions.

The debate is welcome, even with much mismanagement. Pristina is supplied by three main sources -- Batlava, Weman and Badovci. Of the first two more than Badovci, but really only Badovci is in the Pristina municipality. We have removed all the sewage from Lake Badovci with the Czech State project, and we have allowed no construction without permission in either Zone I or Zone II, nor in the area III that belongs to the Pristina municipality.

It would be good to have the same situation in Lake Batlava, where construction is still under no leave in all areas without any protection. At Lake Batala, we also have motor vehicles in the water that are strictly forbidden in artificial lakes. There are also tourist objects, such as restaurants that are built almost in water. So once again Pristina gets more water from Batlava than from Badovci.

From Weiman we take about 700 liters per second, which in open channels over 30km of water reach the water factory in Shkaby. Even this is not in Pristina territory, so we have no information about the construction or the potential risk to water we use in Pristina.

So we are not the first or the last to have springs of water that protect us from danger. As a municipality, we have taken all measures to provide 24 hours of water and also to protect the lake from potential dangers. We have expanded Germia's protected landscape to 2,000 hectares that capture much of Badovci in the municipality's territory. Area II is not of the strict regime, and the ministry gives consent, even though we as a municipality have refused even this (maybe without legal grounds).

But it would be good to have such debates about all water resources and where we may have a far greater risk than in Badovc. Very well, our society is becoming aware of environmental problems and risks, but we hope to be consistent, argumentable and united in environmental protection.
