Controvers analyst stands up for two Catholic radicals who offended Kosovars severely

Albanian extremist analyst Kastriot Myftaraj, through a writing posted in his Facebook account, has reacted to the Anti-territorial Directorate in the State Police, who are in search of two religious radicals in charge of criminal work “Hatred or squabbling”, after the same offensives the Muslims from Kosovo and Macedonia [...]
Myftaraj has said that two Albanian Catholics are victims of the video approval of Kosovo anti-national Islamists, while he calls everything deliberate and monstrous by the author of the video.
This is his full post:
After publishing three videos from the Kosovo newspaper “Insander”, where two Albanian citizens appear, expressing some thoughts about the Muslims of Kosovo and Macedonia, the Anti-Terror Directorate at the State Police announced that it had declared the two persons shown in the video and that it referred the materials to the Prosecutors of the Shkodra and Lezha District, tasking the criminal work of “Indirection of hatred or disputes”, envisioned by Article 265 of the Penal Code.
From video content analysis, with a length of 18, 9 and 11 seconds, it is understood that not only the two persons shown there, Anton Zefi and Louis Mark, did not perform the criminal work they were assigned to, but is even the staff of the newspaper “Isader” and the author of the videotape that committed criminal acts. To clarify from the beginning one thing, that serious, even very serious, words, said, are not criminal acts simply because they have been told, but a whole set of elements are required to have criminal acts. I'm not saying a criminal offense because it's a category that no longer includes in our criminal law.
By the State Police's Antiterror Directorate's announcement, it is clear that serious procedural violations have been made by judicial police officers attached to the directorate. This clearly appears in the first lines of notice, which reads:
“Two radical Catholic religious leaders from Albania, through several videos that have come to the newsroom Insander, are heard insulting Muslims from Kosovo and Macedonia who go on vacation on the Albanian coast, inform you that: State police have immediately launched relevant verifications to put these commentators to legal responsibility, who, with their comments, stir up hatred and contention. Of the entire procedure action that has been committed has been identified by the two people who have spoken with hate speech. ”
The first violation of many amateurs, therefore too heavy for a specialised police director, such as Antiterrorism, is that it has come to know about the publications of “The user” acted only to identify the individuals shown in the videos. But they have not acted to sequencing “videos via the Kosovo Police Insider” and interview the newspaper staff for their source. Because it's very important to find out who did the videos.
Second, Albania's police should have asked Kosovo's one to question the video's author according to “Inseder” information. The author of the video was to be identified for the needs of the device he did video recording with. Whether “Insander” says you don't know the author of the video, and that they sent him to the Internet, he has to tell the address of where he came from. If the video's author is hiding, this raises serious doubts about the matter. Why is he hiding? In a court case he must be a witness, that's all he needs to know. Has he received assurances that he will be set aside? The Anti-Terror Directorate has acted unilaterally, with the intent to blame those who appear in the video and fail to conduct necessary preliminary investigations.
The Antiterror Directorate has judicial police officers who are experienced lawyers. At least two judicial police officers attaching to the Directorate are on the issue. From what they've used in notice, I understand their legal problem and I can imagine who has the dubious honor of this invention. The jurists of Antiterror well know that for this issue to stand, that there is a criminal fact, depends greatly on the circumstances of the fact.
And that's where we come in the third step too heavy. From published videos, it seems that words were spoken in a closed environment, in a room, so it's about a private conversation. There can therefore be no criminal act predicted by Article 265, which is formulated in the way words are required to address at least one public audience. Even a conversation on a table at a coffee shop cannot be called with a public audience if the conversation remains on the table. The speaker should deliberately address those present at the cafe to cross the line of private conversation. If private conversations with Article 265 are criminalized, then we will need a hundred more prisons to hold prisoners and hardly enough. Anti-terror lawyers know this well, so they call him Zefi and Mark as “containing”, who've done “ ”. Commentators of what? Turns out someone else made a statement that was then commented on by the two people showing up on video.
Calling Zefin and Mark commentaries, the Antiterrorism Directorate has claimed that published videos show only part of the event, what it wanted “Inside” and video author. But the rest of the conversationators have not been published, which has prompted the comments of Zeph and Mark. It is not ruled out to have been the text of the ancient jihadists. Because Jeff and Mark seem very nervous on the video and after all odds they say, provoked, things they wouldn't have said, at least not in such extreme terms, if they had been in a quiet condition.
The way Zefi and Mark express themselves in the video is understood to be that they are involved in a debate with at least another person or some persons, present, one of whom is the author of the video. This person, or these persons are Kosovo Albanians, Macedonia or both of these countries. What especially impressed you is that neither of the three videos is given the words of other participants in the debate nor their faces. Well, those are the words that have prompted the comments of Zeph and Mark.
All of this makes me doubt that they have been Albanian-speaking Islamists of either Kosovo or Macedonia, or by both of these countries, those who have used a provocative method that they have used several times against me Islamists here. Years ago, it happened to me once to be stopped on Islamic streets, who observe correct conduct as a beginning, even accompanied by children to appear peaceful, and after a greeting they say their words, something like: “Coming Kurban Bajrami, will you make sacrifices? The great Cuban will take place when the day of European Khalifat will rule Europe and Albania. Whenever they become no animals, but those who are worse than animals, Christians, Jews, laymen; they will beheaded under the sword of God's righteousness. ”
In any case the conversation is recorded without my knowledge, I understand that. The goal is to get me violent statements and then distribute the video by acting like I gave a speech to the public. Understandably, they would take care to cut the part in their own words.
I have the impression that a similar provocative scenario has been applied to Zeph and Mark. When the common people are provoked they don't know how to refrain, that's a familiar thing. Zeph and Mark may truly have the thoughts they have expressed, but for their sayings to constitute a crime according to Article 265, there must be a criminal fact. In the concrete case, with data released, it could be said that the fact is not provided by law as a criminal offense, so the criminal case should not have started and that after it started it should be fired. (Nini 328 of the Criminal Procedure Code)
No sub of the Criminal Code envisions as criminal acts of any kind of private conversation with hate content unless they are aimed at recruiting for terrorist acts, which is not the case.
What is presented in an official announcement as the Antiterrorism Directorate should be remembered that its official appointment is the Directorate of Investigation and Prevention of the Terrorist Act, so it has the obligation to make investigations before making decisions. And if he had investigated the guilty, he would have discovered the jihadist scenario. (Jihad also deals with propaganda)
In addition to the above, the video has not been made, nor has Zefi and Mark spread it, but their conversationors, who have sent the video to the newspaper “Insider”. The conversationaries are obviously Kosovo or Macedonia Albanians.
Another thing that impresses me about the police announcement is it's not said when the event happened. As “Inside” does not say when the event happened. Strange that a media specialising in research like “Isander” ignores all these basic research things. Copy, “Inside” is part of the dirty ancient script. By the way that he acted “Insander”, not only should he pay a good financial compensation to the two citizens of Albania, but Parim Oluri and Vehbi Kajazi, the director and editor-in-chief, respectively, must keep many years of prison in Albania because such scenarios are not related to journalism.
Purpose of provocation of “This is Anti-Atlanticism. “The Isander” is that it calls both people on video, Catholic radicals. Although these are Catholics, easily understood by their names, they did not use any religious formula to show that their radicalism was of Christian and Catholic descent. A Muslim-named man is called radical Muslim because he uses the “formula, while Akbar Mahks5>.
It is shameful that Albanian Public Television also gives the news, calling it Zefi and radical Catholic Marks.
It is surprising and intriguing that the Albanian Catholic Church, its leaders, the Archbishop Conference and its chairman are not responding to the event. Where is journalist priest Dom Gjergj Meta? It is a big mistake for the Albanian Catholic Church to remain silent when two Catholics become victims of such scenarios and slander Catholic radicalism. If they remain silent in the name of preserving their religious coexistence, it is unfortunate. Left helpless and threatened in police offices, Anton Zefi and Louis Mark may claim a crime they have not committed at all. That should not be allowed to happen.
Zefi and Mark's lawyers must make criminal remarks to the newspaper “Inseyer” (in Albania, not in Kosovo), as well as judicial police officers from the Anti-Terror Directorate who have made a decision to arrest them as well as to the author of the video. It's a special task of Interior Minister Sander Lishey, I think special as a Catholic, to order him to investigate how some Antiterror officers have been involved in this story. In my opinion, the cause of the conduct of Anti-terror officers has to do with Turkey's strong influence on them. Since this was established in 2014 and has so far been under the auspices of Turkish counterpart. Turks certainly know how to seduce and attract some of Albania's Antiterrorism people, asking for a small reward, like some Catholic heads they bring to the chopper by means of their Kosovo Islamic provocations. There is no further explanation for the unprofessional professional behavior of Anti-terror officers in the case in question.
