Without a decision by Kosovo President Hashim Thaci to move to early elections, the Vetevendosje Movement initiative for the dissolution of the Assembly, in order to create conditions for elections, will be difficult and feasible. Following Ramush Haradinaj's resignation from the post of Kosovo prime minister, political parties represented in the Kosovo Assembly are awaiting invitation by the country's president, Hashim Thaci, for consultations regarding further steps.

Political parties are waiting after these consultations to determine the date of early elections, though the country's president may consider finding a new mandate for government prime minister, without going to new elections.

Florent Spahija, legal expert from the Kosovo Democratic Institute, says the country's president, based on the Constitution of Kosovo, does not have any legal deadline for consultation with political subjects.

According to him, the function of the Kosovo Assembly does not depend on the failure of the Government and the latter stems from the Parliament. Consequently, the Assembly could issue a new government, if it has a new candidate for prime minister from the current ruling coalition.

The president may try to drain all options and offer it to the Constitution. Normally, if there's a new candidate and he's out in the Assembly, then you have to go with regular voting procedure. If he gets 61 votes, then the country could have a new prime minister and government, without going to the elections”, Spahija stressed.

But, in favour of early elections, the Vetevendosje Movement has indicated. This party's deputy in the Kosovo Assembly, Glauk Konjufca, has stressed that if the date of elections in Kosovo is not known during this week and if the president will raise the issue of a new mandate, then the opposition will target the Parliament's self-determination.

“Vetevendosje Movement, next week, along with the Democratic League of Kosovo, which we will address, will call an extraordinary session for the self-exploitation of the Republic of Kosovo”, Conjufca has said.

Meanwhile, officials of the Democratic League of Kosovo, contacted by Radio Free Europe, have given no answer as to whether MPs from this party, deputies of the other opposition opposition Movement Vetevendosje, in the initiative for self-determining the Kosovo Assembly.

The Alliance for the Future of Kosovo, this partner within the current ruling coalition, whose leader is Ramush Haradinaj, has in some cases reconfirmed its position that the country must go to early elections.

Kosovo Democratic Party Chairman Kadri Veselini has said on Saturday that after Prime Minister Ramush Haradinaj's resignation, the elections are already inevitable and that what can be discussed is only the time when they will be held.

The legal case expert, Spahija, stresses that if political subjects who are represented in the Kosovo Assembly manage to secure the necessary number of votes, as the country's Constitution envisions -- that is, 81 of a qualified vote or majority -- then they do not need to wait for a presidential decision, but can vote on the decision of the Parliament.

We have seen this several times the Kosovo Assembly. So, when he's decided to self-defunct, then the MPs voted. The important thing is that the Parliament, at the moment it makes that decision, then the country goes to the polls under constitutional terms”.

So, 45 days after that, elections should be held. But, usually, in Kosovo there have been cases that have not been spent 30 or 35 days and elections have been held, from the moment the Assembly was disbanded. For now, there's no such move. But, if opposition parties have said that, then they should count on 81 MPs to vote on such an act”, Spahija stressed.

However, so far, Kosovo President Hashim Thaci has not yet issued a statement on when he will call for consultations political parties represented in the Assembly, nor for what actions he will take following Ramush Haradinaj's resignation from the country's post of prime minister. /rel/
