Justice Reform, Chief Great: What we approved by 140 votes has not been realised

The chief has accused the Socialist Party's majority of distorting it with full restraint to implement reform, which has also brought the chaotic situation to the institutions of justice.

“This was the key moment that enabled Albania to receive the first positive recommendation, the same year from the European Commission for the opening of negotiations. It was the will for consensus, political dialogue, but also our determination to adopt this reform. The deformation done, with complete basket by the relindas, in implementing the justice reform package we drafted with the help of partners has led to the current chaotic situation and without yet having key justice institutions and the overall functioning of the rule of law”, the LSI chairman has written among other things.

However, the Chief Head emphasises that “despite all the current reform defects, me and the LSI today are even more determined than 3 years ago in the need for reform in justice, for its release from the political-climate grasp, independence and increased integrity of the justice system in Albania”, writes Top Channel.

Today, 3 years after the adoption of constitutional changes for reform in justice, what we approved by 140 votes and national consensus has not yet been realised on July 21-22, 2016. Independent justice system, with integrity, Western standards to provide justice for citizens, fight organised crime and government corruption. A system where the government would no longer influence, but with its independence the system would give justice and everyone would be equal before him.

This was the key moment that enabled Albania to receive its first positive recommendation, the same year from the European Commission for the opening of negotiations. It was the will for consensus, political dialogue, but also our determination to adopt this reform. The deformity done, with full exchange from the relindaents, in implementing the justice reform package we drafted with the help of partners has led to the current chaotic situation and without yet having key justice institutions and the overall functioning of the rule of law.

The lack of the Constitutional Court has led to the adoption by the force of blind cardes of unconstitutional laws in Parliament, proposed by the resurgent majority. Laws that are clearly at the expense of public interest, but without any real possibility where citizenship can be protected in the face of government arrogance, lawlessness, and arbitration.

The Supreme Court's absence has led to over 30,000 cases blocked for trial, where citizens cannot gain their right. Instead of equality before the law, the captured justice system from the Renaissance organisation has turned into the largest project of inequality towards citizenship and public interest in the face of the government and the corrupt interests of power.

The Davidend law is the only one in the world's self-responsive powers. Those who do not take advantage of this trade are small and medium-sized businesses, free professionals, and all citizens who earn their livelihood from honest employment, which are held monthly income tax directly from their salaries or incomes. It gives companies the right to have millions of euros in profits accumulated in years, without spilling fiscal duties, to pay taxes on profits less than 99% of Albanian citizens.

Concessions and PPPs, and more in cost to defraud as much money into the government's external accounts, bringing the murder of fair competition and the concentration of 3-4 oligarch hands of all income from Albanian taxes, are just some of the cases where it is clearly testified to what the failure of the justice system does.

Also an extraordinary deformity of the reform consensus in justice and recommendations of the Venice Commission is the choice of the General Prosecutor by 69 votes. It was breaking the rules of the democratic game by the cartoon blindness that brought what was expected from this vote, the silence of the prosecution body in the face of government corruption scandals, and the authorities' criminal acts in deforming free voting in co-operation with organised crime gangs.

Currently today, each Albanian citizen has a clear understanding of what the deliberate deformity of reform in justice means. On the one hand, we have citizens, prosecuted for protesting to protect the right to free vote, property, against criminal taxes and total silence with power scandals.

After more than a year, we still don't have a defendant for the New Ring-building tender scandal at the value of 33m euros, where they forged sunday documents even in front of all Albanians. Also heavy files, 184 and 339 of vote purchases, instigation of voters with a living and a job, with pressure from criminal gangs against voters, which is clearly seen as misappropriating the official post, such as through state violations, how neither law nor voter rights are asked, sleep peacefully until it is time to be shut down. These are “the tangible results of deforming constitutional changes and the consensus reached on July 21-22 of three years ago.

Three years ago, we like the LSI voted with conviction that the change we expected would strengthen Albania. It would boost the new generation's confidence to stay in Albania. It would create fair competition conditions and lure foreign investors to see Albania as a country where it could invest. To enable foreign investment to open well-paid jobs, as necessary today, for Albanians not to abandon the country. To develop the economy and for more progress in the lives of Albanians.

Despite all the current reform defects, which do not result from constitutional changes made to reform in justice, but are like deviations that have been made to this reform by the majority to protect itself, their partners in the economy, and their associates in organised crime, LSI and I are even more determined today than 3 years ago in the need for reform in justice, for its release from political-climate grasp, independence and the growing integrity of the justice system in Albania.
