The justice system, according to the connoisseurs, has failed in light of this murder. They also say that since Zyber's murder, Kosovo continues not to extend full authority in the country's north, viewing the security situation as fragile.
On the order of then-Prime Minister Hashim Thaci, on July 26, 2011, numerous police forces have ordered Mitrovica to extend the country's sovereignty to the north. Near the village of Caber, after 20 minutes of fighting between the forces of members of the Special Operations Unit -- ROSU and a group of people who were said to be from the Serb community -- Zymber has been hit and seriously injured. After a few hours he died, failing to handle his wounds.
After the tragedy, the justice system, including EULEX, has begun investigating this case and as suspects had six people, four of whom were arrested. The investigations have ended with the raising of the indictment by the prosecutor of the Constitutional Prosecutor in Mitrovica, Fatmir Syla, and EULEX prosecutor Pascal Persoons. However, in the indictment it was not determined which of the defendants killed Officer Zymber.
The prosecution had based it on the testimony of a member of the police in action. He is of Serbian nationalism and currently has the status of a protected witness.
The indictment claimed that about 50 members of the Special Operational Unit ROSU and a group of 10 to 15 Serbian people had exchanged fire for about 20 minutes in the vicinity of the village of Caber on 26 July 2011.
