Constitution gives Thaci rights for KEC members' appointments

The subject of the issue of application was to assess the constitutionality of the president of the Republic of Kosovo's decisions for the appointment of members of the Central Election Commission of the Republic of Kosovo: William Kurtiši as a member of the CEC from the Bosniak community; Stevan Veselinovici as CEC member of the Serb community; Ercan ʼpat as CEC member of the Turkish community; Alfred Kinoll as a member of the CEC, as a representative of the Roma, Ashkali and Egyptian communities; as well as Nazlie Bala, Adnan Rrustemi, Florian Dusi and Sami Hamiti as members of the CEC.

“The petitionors claimed that they were not compatible with Article 4 [The Central Election Commission] of the Republic of Kosovo Constitution”, said in the Constitutional announcement, until it becomes known that “the request was based on Article 113, paragraph 2, submerator 1 [Juridication and Authorised Pals] of the Constitution, in the 29 [Sacrificement] and 30 [Affats] of the Constitutional Court (Acrifications]. 03 L-121, as well as rule 32 [Preparation of requests and responses] and 67 [requirements in accordance with Article 113.2 (1) and (2) Constitution and Article 29 and 30 of the Constitutional Court Law] of the Constitutional Court's work regulator”.

The court reports that in support of Article 113, paragraph 2 subparagraph 1 of the Constitution, articles 29 and 30 of the Constitutional Court Law, and in support of the rules 59 (a) and 67 of the work regulation, it first decided to declare it acceptable for consideration of this requirement.

Second, the Constitutional Court has found that Thaci's decisions on the appointment of the above “are not in conflict with Article 4 of Article 139 [The Constitution's Central Election Commission] of the Constitution”.

Thaci had stalled the issue of naming new members of the CEC, saying it is unclear how he should act after the result of the last elections, held in 2017. Following international pressure, he had asked the constitution how he would act, which had instructed him since Albanians from two candidates in the CEC belong to the Vetevendosje Movement, the Democratic League of Kosovo and two other pre-election coalitions. This coalition had refused to bring its names to the president, since three subjects made up the coalition P The DK, AAK and Initiative, and all three claimed to be deserved by a member of the Central Election Commission. So they've turned to the Constitutional again.

The CEC remains with minus two members, however, it is estimated that even without these two is functional and could deal with organising possible early elections.
