Court testimony to the payment murder in Decani due to a debt

He has said that as a result, he had resulted in a beating by Bekim Raja by Djind Turkey.

I've had Mark's friend of the spirit, and I've known Ferdinant through Mark. Ferdinand was a very sincere person. I know that Mark and Ferdinand had a conflict with Bekim Raja for a home in Pristina, and the conflict has come for 10 thousand euros”, this witness has declared.

For Raj's beating, he said he understood it from his friend Kqira, who had trained them in the case.

We're in the house when Mark called me on the phone and he got my nephew and Mark on the phone, told my nephew that I had a word with Bekim Raja, and I called Mark and I told him “what was done”, and he told me Mark” what to do, or what to do, that he did it to us in word, he said.

Witness Berisha, has stated that when he went to the home of Mark Kqira, he had told him that Bekim Raja had spoken gravely to him and had told him that he does not tire of the 10 thousand-euro debt.

When I went to Mark's house, the police had been looking for Mark, after the police went in and called Mark on the phone, and after a few minutes he came home with his uncle's two sons. Mark told me that Bekim had spoken gravely to him and had opposed him by saying that he does not tire of borrowing 10 thousand euros. Mark told me that he was more serious when Bekim Raja had offended his friend Ferdinand”, Berisha said.

In these minutes of conversation at the Kqira house, witness Berisha has said he has now called accused Raja.

After a few minutes Mark's phone was ringing, it wasn't a name number, and I got off the phone and it was Becky Raja. I told Bekim that Mark is not here. Bekim told me that I left a message to Mark, and that “I gave my sister, I gave her 9 year old girl if she eats Christmas and New Year's Eve, I have to wash the orphan family and mother to him”, the witness Berisha said.

In the question of prosecutor Valbona Dishaj-Hajoya, that during the conversation between him and the accused Raja, did he now mention the late Djindian, the witness answered by saying he did not mention Djind during the phone conversation.

To avoid this conflict, witness Berisha has said that he and his brother had tried to reconcile Raj and Kqira, but had failed to succeed.

The conflict has then come in summer when Mark and Ferdinant together have been beaten with Bekim Raja in the Pisca town of Gjakova”, the witness said.

After Bekim Raja's beating, witness Berisha, has claimed to have met with Ferdiand Djind, and Mark Kqira, but according to him, he had not expressed any concern or fear, while in his opinion, he had not talked about it.

But for this witness's statements, they have been opposed by the defense of accused Bekim Raja, lawyer Arian Koci.

According to him, hearing this witness is unnecessary because it is not the case of Ferdinand Djind, but of Mark Kqira's murder.

In the question of lawyer Koci, the Raja family -- except for the current problem with the late Mark Kqira -- had any other problems, witness Berisha -- has replied saying he did not know that, because as he has said, he does not care for foreign affairs.

He has later said that apart from the problem that Kqira and Ray had had with him, he did not know any other problem that his friend had had.

Otherwise, it was the initial hearing of witness Christian Markaj at the hearing, but with the prosecutor's proposal Disha-Hajoje and the reconciliation of defendants, his statement given to the prosecutor, and in the previous court review, it is considered read.

Meanwhile, the request for the release of wiretapping in the judiciary has prompted this controversy between lawyer Koci and prosecutor Disha-Hajoya.

Koci has asked that public talk be heard conducted over the telephone at the Pre-prison Centre, among the defendants, which prosecutor Disha-Hajoa rejected.

You don't know who's talking and at most it's not clear what's being spoken and it's not well heard and it's supposed to be here publicly listening to wiretapping”, Koci said.

However, the prosecutor has said she disagrees that wiretapping is not agreed to be heard in court, since, according to her, it is a waste of time and that there are written transcripts, which have flows of wiretapping.

While defendant Avni Sinanaj's defender, Kosovar lawyer Kelmendi, has demanded from the court that Friday's hearing be postponed after she said she had discovered evidence during the day, which, she said, counter the legality of these wiretapping.

According to Kelmendi, there was no such evidence at Friday's session, and for that reason he requested that they be handed over to the next session.

Such a proposal has opposed prosecutor Disha-Hajoaj, the representative of the damaged party, Korab Bocshi, and defender of accused John Pnoschi, lawyer Ndek Dodaj.

Judge Sami Shardaku, later approved of attorney Kelmendi's proposal for the postponement of the session, while regarding the proposal that wiretapping be heard publicly, has said he will decide at the next session.

In contrast, according to the indictment filed on July 26, 2018 by the Constitutional Prosecutor in Pec, defendants Avni Sinanaj, Murat Sinanaj and Bekim Raja are charged that in May 2012 in Switzerland, defendant Bekim Raja for the purpose of postscriptulous revenge has ordered defendant John Pnishi, who is the last one along with defendants Avni and Murat Sina, to carry out the murder of Ferdinand Djind by promising and awarding a hundred thousand Swiss francs.

The indictment's device describes defendants John Pony, Avni, and Murat Sinanaj as acting in accordance with the preliminary agreement between them in a subtle manner and with the aim of gaining wealth for themselves, deceive the victim by luring him with narcotic substances, in the way that the victim leaves with his car “Passat” from Gjakova in the direction of Decane, followed by defendant John Peshni, to go and get a quantity of narcotics, as the defendant had promised to Avna.

Furthermore, according to the indictment, defendant John Ponysy, acting on suggestions by defendants Avni Sinanaj, to cross into the villages of Hereq, Gramachel, Dubrav, Glodjan, and then reach the bridge that connects the villages of Luc and Backbar, defendant Murat Sinanaj being prepared, detained, and passing casualties on the bridge, defendant Murat Sina, has shot by automatic weapons in the direction of the victim, causing deadly injuries.

Initially, he was accused of being convicted by John Ponyschi, who had been convicted of this murder and had been sentenced to 18 years in prison by the Péja Foundation Court in June 2016.

But after that sentence, he has agreed to co-operate with the prosecution in connection with Ferdinand Djind's murder, for which the Court of Appeals had turned the case into retrial in February 2017.
