The Constitutional Court in Pristina has sentenced two years in prison on bail to two accused of serious theft, Granit Simnica and Flamur Stublla.
This conviction pronounced against them will not be executed unless the two accused commits other criminal acts within the two-year term, reports “Justice Vowif”.
They have been sentenced to a fine of 300 euros, which they also are not obliged to pay on condition that they do not commit any other criminal offence for two years.
The indictment against them was announced Thursday by Judge Fatime Drmaku, who has announced that the disgruntled side has a right to that ruling within the 15-day deadline of receiving the copy of this act.
Otherwise, before the indictment was pronounced, the two accused at Thursday's initial session have pleaded guilty, and have expressed regret over their actions, promising the court that in the future they will not repeat similar actions.
The defender of accused Granit Simnica, lawyer Sadije Medici, has claimed that the guilty plea by her defense was voluntary.
I beg the court to first ease the sentence on this case, in terms of my client, so that the minimum sentence is softened according to Article 76.1 points of KPRK, and then the smooth sentence of responsibility is conditional on provisions of 50, 51, 52 par.2 of KPRK, and to pronounce a parole sentence because I am convinced that the same has understood the weight and importance of criminal responsibility for itself and the social risk of the work done. Even on bail, I consider the purpose of the sentence to be reached under KPRK's 41st Article”, said Medici, reporting the bias.
The guilty plea was not rejected by prosecutor Fatmir Behrami, and was subsequently approved by Judge Fatime Drimak with the reasoning that it was voluntary by the accused, without pressure, and that this admission finds support in the evidence and facts that are part of the subject paperwork.
“proposes to the court that, in the case of the verdict on the sentence, the same assesss as extenuating and exacerbating circumstances and in terms of easing the sentence proposed by the defendant Grani's defender, it is left to the court to impose”, prosecutor Behrami has said.
Otherwise, Pristina Constitutional Prosecutor, on 21 June 2017, has filed an indictment against Granit Simnica and Flamur Stublla in the direction of carrying out the criminal work “The heavy recovery”, by Article 327 par.1 under par. 1.1 related to KPRK Article 31.
According to the indictment, on March 9, 2016, about 11: 00 p.m., in Pristina, on <x0... Sali Nivica”, the accused after the preliminary agreement, with the aim of embezzlement of flammable wealth, that it brings an illegal asset to itself, with the use of force has opened the front of the type “car. Golf II”, the property of now damaged Astrit Miftari, and from there they have managed to obtain the acumulator worth 70 euros, with which the allegations have caused him considerable material damage.
