While the United Education Union of Kosovo has chosen to ignore the Constitutional Court's decision to compensate for lost hours during the 3 week strike, representatives of this Union have delivered the course to the Court of Appeals today.

Disgusted with the decision of the first, unionists have put their hopes on Appeals.

In this case, SBASK chairman Nakman Jasharaj says that from this court he expects to make the right decision, not denying teachers and trade unions their right to strike.

Jasharaj says that until the Court of Appeals is brought to a decision through which the Education Minister's decision, Shyqiri Bytyqi, SBASK will not be averted for a moment.

While expressing his confidence that any decision made there will not deter the union, which in case of need will also address the headquarters of the Union of European Unions in Brussels.

In an interview for KosovaPress, Jasharaj calls the decision of the Constitutional Court in Pristina emotionally and politically influenced, which has made a decision to compensate for classes lost during the strike.

“We will continue with the battle with the courts, I hope that the court will decide correctly, if not, we will act until the last institutions and in the material we are preparing, we will also announce Brussels where the Union of Unions of Europe headquarters is, so that they can analyse it with their experts, who will seek their support, even in some of their own courts. Because I'm saying, it's not a matter of hours, because hours are known to be not being held, even where they're held to say, but it's a battle of our union and for other unions to protect strike force”, Jasharaj said.

Although in an interview given earlier for Kosova Prees had stated they would implement the Pristina Constitutional Court ruling, Jasharaj this time shows why they ignored the latter's decision. As he adds that if this Court brought a law - based decision, they would accept the latter's decision to compensate for the hours.

He says that in a lack of professionalism in the field of justice, he didn't know how the scales of the justice system go.

Once we've done the analysis of the material that's returned, we're very unhappy... We've asked the Court to say that the minister's decision is based on law. And we know it's not based on law, but it's based on certain guidelines. What made us continue the battle with the courts is that the Constitutional Court in Pristina is summoned to UNMIK's time administrative directive, 44/2005, which concerns the then law of inspectors and education at the time of UNMIK, which has been depreciated by the institutions of the Republic of Kosovo with the Law for Inspectors, and with the law on pre-university education”, Jasharaj said.

He even says that the Foundation's decision was based on emotion and on the impact of the extraordinary session that had been held regarding the replacement of hours.

We consider that it has also been an emotional decision, even though not as chairman I believe it has also affected the debate that took place in the Kosovo Parliament, the superiors, a very low debate at some point, quite insulting. And, I consider that the judge has also influenced the Assembly hearing and emotions, because the court's letter says: it's good to keep the clocks for the students' sake, for the sake of interest”, he said.

Jasawar says the practice of compensation hours should be interrupted, as strikes are lost. Because, according to him, if the teacher strike is not protected, it will have a negative effect on other unions.

As he repeats that if there will be even of the cofficient for teachers and lower-cycles with those in the 6-9 grade cycle, for the sake of solidarity with them they will compensate for lost hours during the strike.

All of this, it says, does not mean prioritizing teachers in front of students
