The Constitutional Court in Pristina - the 38-year-old Department of Crime - has ruled concerning the request of the Special Prosecutor of the Republic of Kosovo for the appointment of the detention move against indictees Metin Islami, because of the suspicion given that the same has committed criminal organisation and participation in terrorist groups by Article 394 (a) and 396 of the Northern Macedonia's KPR.
The court has taken office and defendants, Islam, also known as “Commander Talibani” has been assigned the detention measure during 40 (four ten) days, broadcast Indescline.
The court has analysed all the reasons for the detention assignment and approved the prosecutor's proposal for prebugisation, because if the fugitive Metin Islam was found in freedom, the same could leave his home and be elusive by the prosecution bodies, since the same is a citizen of the Republic of Northern Macedonia and the same is required by the authorities of the Republic of Northern Macedonia because of the criminalisation work and participation in terrorist groups by Article 394 (a) and 396 of the Northern Macedonia's KPR. The Court also considers the legal conditions previously met in Article 187 par. One below. 1.1 and 1.2 points 1.2.1 of KPP, because if the fugitive is found in total freedom, he will escape and hinder the development of the extradition procedure.
The side has a right to complaint against that decision at the Kosovo Court of Appeal.
“Comandant Talibani” was arrested this week by police investigators from the Pec region at Pristina Special Prosecutor's order.
Islam was arrested on March 12th 2019 by the unit for fugitives ( FAST Kosova), but having a case of escape for fugitives had been banned by the Pella Foundation Court, the branch in Istog.
