The businessman from Gjilan tried to consciously be sentenced to prison

The Constitutional Court in Gjilan, the branch in Kamenica on Thursday, businessman Avdullah Bajra, has sentenced him to three months in effective prison for criminal work “causing general risk”, until he has acquitted of contempt of court. He, too, has been obliged to pay the 20-euro judicial wig as well as 30 euros for compensation of the victims.
According to the trial pronounced by the court judge, Sadri Krasniqi, the accused has been found guilty of the second points of the indictment, causing general danger, with which he has sentenced him to three months in effective prison.
Based on bias, the accused Bajra on time and place like the device of the indictment, with dangerous action, respectively, has caused the general danger of people's life and wealth, so that as long as the company “Air Energy” has gone to develop the works, the accused has initially hampered them, and then in the presence of police gets a gas fuel-fueled bidon, casts it around his escort, with whatever he tries to light up gas, but with police intervention, where he remains in the attempt.
In the meantime, for the court's first indictment point, it has freed the accused from criminal responsibility, as according to Judge Krasniqi, there is no evidence that the accused Bajra has not respected the Constitutional Court's Act in Gjilan, the branch in Kamenica, C.N.54/18, of April 18, 2018.
Judge Krasniqi has said that disgruntled parties against this act could file complaints at the Court of Appeals in the 15-day term.
The injured, Elmaze Sermajaj, Lulzim Xhaqkaj and Hysen Krasniqi, all police officials, for realising the property-juridic demand, have been instructed in civil conflicts.
Otherwise, during the proclamation of the trial present at the court was accused Avdullah Bajra, but lacked his protector, attorney Shemsedin Pirar, and prosecutor from the Constitutional Prosecutor in Gjilan.
Regarding these two criminal acts, Bajra was accused of committing them not allowing high-tension wires to pass on his property.
The accused Bajra, at previous hearings, had not pleaded guilty to guilt, claiming that he had never committed the criminal acts he was charged with, adding that this case was mounted against him and that witness testimony, particularly those of police officials according to him, are false, with what the respective organs, prosecutors and courts have said.
In connection with the case, two court hearings had failed, that of November 22, 2018 and February 26, 2019, while at the January 16, 2019 session had given their testimony -- Elmaze Sermanjaj, Hysen Krasniqi, Avni Maroca, Arbnor Bajra, Nazmi Hoti and Mustafe Berisha -- already at the March 12th 2019 session, prior to the court had witnessed Lulzim Xacaj, Ganim Vokshi and Albert Bajra.
The Constitutional Prosecutor in Gjilan, on May 14, 2018, has filed an indictment against accused Avdullah Bajra, who allegedly on April 26, 2018, at the Polyqka in Kamenica, at the site called “Buinoc”, has not respected the Constitutional Court Act in Gjilan, the branch in Kamenica, April 18th, 2018.
The indictment says that with the court's ruling, the appointment of the provisional measure, proposed by the accused Bajra, so that as long as the company “Air Energy” heads to perform the works, the accused acting in opposition to the court's almighty decision, prevents the company from performing the works.
With this, Avdullah Bajra was accused of committing criminal work “contempt of court”, from Article 401 paragraph 1 of the Kosovo Republic's Penal Code (KPRK).
In the charge, Avdullah Bajra, in the indictment act, is accused that in time and place as the device of the indictment, the accused with dangerous action, respectively, by dangerous means, has caused general danger for people's lives and wealth, in the manner that until the company <x0 ...Air Energy<1> has continued to perform its work, the accused initially obstructed it, and then, in the presence of police, takes a gas-fueled bidon, puts it around the earth, with its own ability to light it, but with the interference of officials, and remains the attempt.
With this, Avdullah Bajra was accused of committing criminal work “causing general risk”, from Article 365 paragraph 1 related to Article 28 of the Republic of Kosovo Penal Code (KPRK). / Justice Trust
