The chairman and deputy chairman of the Parliamentary Investigative Commission in the case of the deportation of six Turkish citizens have exercised indictments against the Kosovo Parliamentary Assembly Chiefship, for failing to continue the Commission's mandate.
The news about this has revealed the chairman of this commission, Jedal Svechla.
Through a Facebook post, Svechla has said that through this indictment, they are seeking the court to impose the Headship of the Parliament to implement the Law and allow the continuation of the Commission's mandate to clarify the issue of expulsion of six Turkish citizens.
This is his full post:
Due to the obstruction in meeting the Commission's task of lighting up the case of six Turkish citizens, such as the leaders of this Commission, from the mayor's position, Xhelal Svechla and the commission's deputy chairman, Driton Selmanaj, on Monday we have exercised an indictment at the Pristina Constitutional Court, the Department for Administrative Affairs, respectively.
The indictment calls for the administrative measures to be taken against the head of the Parliament because this body has not allowed the Commission to fulfil its legal mandate, preventing the Commission from continuing the mandate determined by law.
The headship claim that the extension of the mandate takes place only with a formal request made by the Commission within the four-month term, is unsustainable since the Parliamentary Reporting Law, at all provisions of Article 6, recognises a six-month deadline to complete the mandate of an investigative commission.
We ask the court to impose the Parliament's Headship to implement the Law, that is, to allow the continuation of the Commission's mandate to illuminate the issue of expulsion of six Turkish citizens.
Even the assembly's own legal office documents recognise the six-month term as the deadline under which an investigative commission must carry out the job and hand over one or more reports to the Assembly on the investigated case. The head of the Parliament has ignored the conclusion of the chairmanship itself that a commission should apply for extending the deadline over a period of six months. As the commission for enlightenment on the issue of expulsion of six Turkish citizens when we requested extending his mandate, it has been in the fourth month of our formation, which makes this demand completely legitimate and legal.
