According to Blakaj, Kurti's reaction is inappropriate because no one can get involved in judicial affairs.
“The Fund for Humanitarian Law in Kosovo has tried war crimes that have been committed in Kosovo since 1999 so far. There have been very few judgments and a small number of people responsible for war crimes that have been convicted. According to Kosovo criminal trials monitoring data, there are 41 people who have been sentenced to an almighty trial in Kosovo. This number is small, the overwhelming majority of victims have not seen justice”.
The incoming prime minister's “reaction is inappropriate and is a kind of mix in the competencies of the judiciary, from the political point of view, no one has the right to demand that within a short time the judiciary take action. There are other bodies monitoring the work of the judiciary”.
There was no need for such reactions to come from the political level, as well as the Special Prosecutor's response even though it contains logical reasonings, but such reasonings do not prejudge the work of the special prosecutor's office. The Special Prosecutor has filed several charges in several war crimes cases, it would be good to make this more active to conclude cases even cases which are preliminary procedure”, Blakaj said.
Blakaj stressed that changing the Penal Code for Judgment in absentia does not help the victims, but only causes anxiety for the judiciary.
He has also cited the case of Croatia's state, which he said did not practice judgments in absentia.
This has been the motive of VV deputies more than a year who have proposed the amendment to the penal procedure code that in that way even tried judgment in absentia so as to have as many judgments as possible. Our organisation has rejected it because we are launched that according to some promises these court processes in absence bring more headaches to the judiciary than have helped victims”.
The crimes in the absence of none of them contributed much. Victims' families have not been satisfied with the fact that those who were convicted in these judgments in absence are not keeping the prison. We have been opposing these judgments in absentia, and very often those who have proposed these changes to this criminal procedure have been called, for example, Croatia. But he didn't practice judgments in absence”, he said. Kurti, through a Facebook post, has been called to account by the Special Prosecutor Sunday for failing to judge war crimes.
While the Special Prosecutor through a communique for the Media has reacted to LVV leader Albin Kurti's statement. The response is said to have inherited about 900 war crimes files from EULEX in late 2018, as well as about 2,000 files on missing persons.
