Accused of propaganding for “I SIS” requires Appeal to ease sentence

Sentenced to effective prison after being convicted of terrorism-related criminal acts, Berat Qamili is seeking from the Court of Appeals to ease the sentence pronounced by the first degree.
Qamili is accused of supporting the terrorist organisation “through social networks ISIS” and had called for joining “The holy war for jihad”, reports “Justice Vow”.
For this work, the Constitutional Court in Pristina, on August 30th 2019, had convicted the accused Qamili and had tried the same one with six months in effective prison.
The prosecution against accused Qamili was announced by the head of the court, Judge Albina Shabani-Rama, after he had pleaded guilty at the initial hearing of August 27th.
The pronounced sentence will also account for the time the accused Qamili spent in house arrest from November 20, 2017, until January 20, 2018.
The accused had been charged with paying the amount of 50 euros on behalf of the judicial patriarch.
Frustrated with the height of the pronounced sentence, the defendant's defender, lawyer Gazmend Ismajli has complained at the Court of Appeals.
The latter has been proposed by the defence to amend the act of Foundation and the accused to pronounce a milder sentence rather than effective prison.
As an alternative to the effective prison sentence, pronounced by the first degree, the defense has proposed to Apel that Qamil impose a sentence on Qamil on him on bail, a sentence of labour for general benefit, or that punishment pronounced by the first degree be replaced by fine punishment.
As attorney Ishmael said in his address to Appeals' college, a milder sentence for protecting him would be more appropriate, given some personal and family circumstances of the accused.
Ismaili said his defense has been excluded from his family and is undesirable because of the criminal act for which he was convicted.
As an extenuating circumstance, lawyer Ishmael also mentioned that his protector is the father of a child who has yet to become a year old.
The accused Qamili himself said he is in serious economic situation, where he said he lives by rent and receives social aid.
On the other hand, the Appeals Prosecutor has rejected the defence complaint so that the second-instance court has proposed that he refuse the defence complaint and prove the first-degree conviction.
The Special Prosecutor of the Republic of Kosovo (PSRK), the indictment against Berat Qamil, had established on January 17th 2018, because during 2017, it continued through the social network “facebook”, via audio-visual shoot posts and photographs, had made propaganda about the terrorist organisation “ISIS”
According to the indictment, he had openly supported the organisation's terrorist actions “ISIS”, such as the latest terrorist attacks around the world calling on all Muslims to join “Holy War for jihad”
The indictment reportedly that he on November 28, 2017, in his account of the social network “facebook”, named Berat Qamili-Qamili, had distributed threatening pictures in which a tire of a blood-painted vehicle was presented in which bloody traces were left with the words “nisu towards them without mercy<3>.
According to the indictment, he had distributed pictures of the soldier of “The ISIS”, as well as the post containing “may be humiliated anyone who put these crows on their houses”, where the flag is, and on December 20, 2017, he was arrested by police.
P The SRK, Qamili is charging with criminal work “reunification or participation in the military or foreign police, in paramilitary or pre-police foreign formations, in group organisation or individually outside the territory of the Republic of Kosovo”.
