Following the certificate of the results of the 6 October parliamentary elections, the constitutional deadline for the institution of the new composition of the Kosovo Assembly is also officially under way.
Under the Constitution, the Kosovo Assembly is elected by a four-year term, starting on the Day of the Constituent Session, held within 30 days of the Day of Certificate of Election Results.
The constitution envisions Kosovo's president calling the first session of the Parliament, but if he is unable to call this session, the Assembly meets without the president's participation.
Florent Spahija, legal expert at the Kosovo Democratic Institute, told Radio Free Europe that the Assembly is considered to have been constitutionalised only when the new chairman and head of the Assembly is elected.
The 30-day <x0 malphat can be used by the president of the Republic to constitute the Parliament, so there may be a chance that he will not make it through this period and then pass this period when the Parliament itself meets. However, the president has the right and freedom that immediately, a day after the confirmation of the results, calls the Assembly session and remands the procedure, since there is a” procedure, Spahija says.
After the Assembly's restoration, Spahija adds, follows the next procedure -- that of forming the Government of Kosovo.
At least 61 votes in the Assembly are necessary for the formation of the Government of Kosovo. To secure the votes needed for the new government, the winning subject of the elections, in this case the Vetevendosje Movement, except the Democratic League is believed to count that the post-election coalition.
