A group of the five non-governmental organisations in the Mitrovica region have accused the Mitrovica municipality of violating the tender for the industrial recycling and recycling project for advance classified or mixed waste. They in this case called on the State Prosecutor to investigate this tender to see if there are elements [...]
During a media conference, these five NGOs introduced the procurement activity monitoring report and the findings were unveiled in the tendering process of the industrial recycling framework project for advance classified or mixed waste, worth about fourm euros.
Kenan Beqiri, from the organisation "Community Building Mitrovica," has cited several violations that were committed by the Mitrovica Community in this tender, which he said were not even recorded by the Procure Organisation (OSHP).
According to him, these violations have caused an economic operator to be eliminated from the race and to be unable to complain, while the Mitrovica municipality has awarded contract to the only operator in the race.
The implementation of the NGO group is that in this tender we have had several violations that were made by the Mitrovica Community and that are not even recorded by the Procuration Manager. These violations have led an economic operator to be eliminated from the race and to be unable to complain, while the Mitrovica municipality has contracted the only operator in the race... The violations that have been made in this tender are, the shortest deadline for submitting bids, delayed corrections in the tender file, for which the Law requires all tender to be cancelled, unable to complain, accepting non-official language bids in Kosovo, and the decision of O The SS that wasn't based on facts. Company A won this tender LFA& RECY Technology that had offered 3 million and 395 thousand euros, and T Company ENIX was the company that had complained”, Beqiri said.
Even Erzen Isufi, speaking of violations made in this tender, has suggested setting the deadline for submitting tenders, for which he said it was made contrary to the Procuration Law, then correcting mistakes on the part of the Mitrovica municipality, as he put it, has been contrary to the operational rules and guidelines for public procurement, as well as other violations.
The last “date for the tender delivery was set June 20th 2018, 2: 00 p.m. Seting the tender delivery deadline is being made contrary to the Procurement Law, which stipulates that for large contracts, the bidding deadline should be the minimum 40 days from the date of the contract announcement. Sins have also been recorded in the case of correcting errors. The Mitrovica municipality had made two corrections of mistakes. The first correction was published on June 18th, or just two days before the last date for submitting bids, which was June 20th. The monitoring group finds that this correction was contrary to the rules and operating guide for public procurement. These regulations say that the error correction announcement should be published in the E-Procure no less than five days before the tender deadline is due, in contrast the activity of the myth procurement should be annulled”, Isufi stressed.
On the other hand, monitoring group member Gentiana Zeqiri has called on the state prosecutor to investigate this tender, to see if there are elements of the criminal act.
“We call on the CRPP, the General Auditor and Anti-corruption Agency to monitor the final project to see if it has been realised in line with the terms of the contract. We also call on the State Prosecutor to investigate this tender to see if there are elements of the criminal act”, Zeqiri said.
Otherwise, the participating organisations at this conference and which have prepared the report were the Community Building Mitrovica (CBM), the possibility, 7 Arts, Civil Development Organisation (CDO) and the Civic Initiative from Skenderaj.
