Special Prosecutor Wants Sentence for LDK MP, Others

All administered evidence proves beyond any suspicion given that the accused committed criminal acts according to the indictment, so I propose to the Court that the same judge pleads guilty and condemn by law”, said prosecutor Feyzulah, Kalxon.com.
In this trial Naser Osmani and Bahri Shaban are accused of misusing official duty at the moment they voted for monitoring of the “Fan” factory.
Those charges were rejected by MP Osmani, Besnik Berisha.
“What it looks like is the prosecution did not enjoy torturing my client from April 2014 to today, but continues to demand his guilty claim for the vote it has given based on his free obedience”, Berisha said.
He said MP Osmani is a victim and sought his release.
“Nasser Osmani is the victim of a four-year persecution, and on his behalf I request his release from the indictment. End this prosecution because there is no penalty without law and the law favours Naser Osman”, lawyer Berisha added.
MP Naser Osmani himself said the prosecution's indictment is not in the spirit of justice and sought to be acquitted of this charge.
This indictment is inconsistent, undignified, and not in the spirit of justice, so I request that I be freed from this prosecution of the Prosecutor”, the MP said.
Bahri Shaban's defender, lawyer Basri Yupoli, said the prosecution has failed to prove his client's guilt.
During this trial as long as it lasted, no single evidence has confirmed the prosecution's claims that my protector has carried out the work the prosecution claims. He and Naser Osman are only accused of raising the hand they had in office and of having to do it, so I ask the court to release them from charges”, attorney Yupoli said.
Lawyers of other indictees sought their protection.
Trial for privatisation of factory “FAN” is one of the cases marked for visa liberalisation.
In this case, Naser Osmani, along with 6 other people, is being tried in connection with the privatisation of the “Fen” factory in Podujevo.
At the time it is charged, MP Osmani has been a member of the Kosovo Privatisation Agency Board.
In addition to that, there are Bahri Shaban, Melita Ymeraga, Shkelzen Luka, Naim Avdiu and Adrian Kelmendi (all AKP officials), and businessman Agim Dodishku as buyer of the “Fan” factory.
According to the indictment, Naser Osmani and Bahri Shaban are charged that, in co-ordination with other official persons and by exploiting official duty at the Kosovar Privatisation Agency, they have failed to meet the task by enabling illegal property benefits to themselves or to the other, the buyers of the New Enterprise “respectively. FAN-Podujevo”, Sh.P.K. MP Agim Dodishk worth about 5,400,000 euros.
The buyer of this factory under contract with the AKP had to make investments in it.
Sabani's Osmani is also accused of being members of the AKP Steering Board have decided and voted “for” that investments made outside the company's spaces be accepted as investments within it, releasing the new company “FAN-Podujevo” from AKP monitoring and terms of the commitments agreement.
By these actions the prosecution claims Osman and Shaban allegedly committed abuse of official office or authority.
Even Shkelzen Luka, Naim Avdiu, Melita Ymeraga, and Ardian Kelmendi in the quality of official persons at the Kosovar Privatisation Agency are charged as Osman and Shaban in connection with the illegal profit for themselves or the factory's buyers “Podujevo's FAN<1.
Luka Avdiu is accused of not taking measures even to implement the contract between the AKP and the factory's buyers “FAN”
Melita Ymeraga and Ardian Kelmendi were responsible for monitoring investments of the company's purchaser “FAN”, while they are charged that “has not checked and monitored investments reported by the investor, have not verified investment statements, made no physical monitoring of capital investments, verifying financial capital investment documentation and employment commitments”.
Agim Dudishk, factory buyer “FAN” is charged with deceiving AKP officials with false submission or hiding facts, prompting them to act at the expense of the company's wealth and employees.
The loser is accused of fraud, legalizing false content, and avoiding taxes.
