In an interview with the Serbian newspaper “Novossti”, Marty, who drafted a report accusing the leaders of the KLA, including current Kosovo President Hashim Thaci, of involvement in “-traditional organs, kidnapping and mistreatment of prisoners” during the war, has said that he was interested in The Hague war crimes Tributal in connection with information and evidence gathered on the ground about what has been called the “yellow house<5>, but that they have said <6> and that the evidence had no longer been removed for any of the former Yugoslavia's space, because they were also able to clear out the <57x.

On the basis of Marty's report, the Special Court in The Hague has already begun inviting former KLA leaders to interview.

Novosti: It's been eight years since your famous report, while the charges have yet to be filed. Are you satisfied with the speed of investigations by justice bodies?

Marty: Your question alone contains answers. If I have managed to complete my reporting for a little over a year, they too have been able to do so in the meantime. U.S. Attorney Clinton Williams in July 2014 had publicly said that the results to which his investigative unit, which consisted of forty highly qualified persons, cover the core of my report. Soon after this conference, he resigned! We waited over a year to be replaced. His successor has gone too. The third has been named, while the results are still out.

Novosti: Is someone doing this intentional?

MartyI may not know this, but I may find that there have been a number of appointments that have slowed down the work of the court. There are two dynamics that clash with each other. I'm convinced that there are people who want to work sincerely at dawning the truth. I also think there are political interests that all of this want to stop. First they believed it would be found. Now they are in a very unpleasant situation because of the fact that the people who supported them were involved in something so terrible.

Novosti: Do you believe there will ultimately be justice for those responsible in the government in Pristina?

Marty: I don't know what to tell you! They may not be punished. You know, most war crimes around the world, unfortunately, remain unpunished.

Novosti: Can you believe the judiciary, if the former Hague Tribunal's prosecutor, Geoffrey Nice, who has allegedly hidden the evidence of “the yellow house”, is now one of the main advocates of Kosovo leaders?

Marty: When I heard this news, I thought there were two Geoffrey Nice! It is meaningless that The Hague deputy prosecutor suddenly becomes a lawyer for the suspects. That sounds at least weird. Perhaps, by the way of justice, it's possible, but personally, ethically, I find it suspicious.

NovostiWhat eventually happened to the evidence? Carla del Ponte has said they exist, while Nice has said they do not exist...

Marty: I know the evidence existed. Journalist Anthony Montgomery was present when investigators of The Hague Tribunal were at “the yellow house” and collected evidence. They did this, however, very amateurly. For example, they did not analyze traces of blood. But they found drugs, syringes, and many other things, and all of this was sealed in the Tribunal.

Novosti: How is it possible that some of your report's leading protagonists still deal with high policy in Kosovo?

MartyWhat shall I say? I wrote that report, and on the other hand there is political reality.

Novosti: Has Hashim Thaci charged you with slander, as you suggested, if you already think you haven't written the truth?

Marty: No. In any case, I am convinced that such an indictment would be rejected. Not only did I enjoy immunity as a rapporteur of the Parliamentary Assembly of the Council of Europe but I can also prove that my report is based on evidence of people who have been directly involved in the works described. There were also those who accused themselves!

NovostiBut witnesses still fear for their lives...

Marty: Of course you know Ramush Haradinaj's case before the international court. Each time witnesses disappeared, there was mysterious death. I totally understand that witnesses fear. That's what I'm convinced of. Those people are scared to the core. They fear for their lives and their relatives. Almost 20 years have passed, new generations have grown and all those people have not been destined to play hero.

Novosti: Do you still have threats?

Marty: It was in my new book that I wrote about a comic situation when, while I was in Bern, in front of the train station, I was waiting for the tram, a man approached me, raised my finger, and in the German language, with obvious emphasis, shouted that I wrote a scandalous report and started out to accuse me of having received 1 million euros from the Serbs for it! There were a lot of people around and watching us in shock. I asked him if I really would be there in the cold weather, waiting for the tram, if I had accepted that amount of money? They all laughed, and he got away with it. There have been threats, but I don't want to talk about them.

Novosti: Everyone says you're brave, which is undeniable. Unfortunately, in the 21st century, we still have to talk about the courage of people who just do their job.

Marty: I really don't pretend I'm brave because, as you said, I just did what was my job. It's not that I'm brave because I do what I have to, but they're cowards who don't. And these are different things. Only the truth about the Kosovo conflict can lead to reconciliation. I've only discovered a few. There is much work left to do in this field.

We've rushed with recognition 

Novosti: When we are in justice, is Kosovo entitled to separate from Serbia, because in the former Yugoslavia it was not the Republic, which, according to the Badinter Commission, has been a condition for secession? Can you use formulas like “sui generators” to solve such complex issues?

Marty: At the time I was president of the Commission for Foreign Policy, Switzerland quickly wanted to recognise Kosovo. I opposed the international legal character, with the support of Professor Cohen's expertise from the University of Geneva. Switzerland is in a specific situation because there are over 10 percent citizens of Kosovo. I think we're in a hurry and we've been able to find another solution. Kosovo already lives in international infusion.

I'd come to Belgrade

Novosti: The Serbian delegation from Strasbourg has invited you to Belgrade. Will your book be translated into Serbia?

Marty: If any Serbian publishing house cared about him, I wouldn't mind! Of course, I have to think about the invitation. I wouldn't go on political visit to the Parliament, but to the university, why not?
