Session for Sekiraq, Court of Europe Knows the address or the number Adelina Ishmael

The Pristina court has failed to locate singer Adelaina Ismaili.

It was pre-arranged today to testify in the trial against Enver Sekirras for instigating the murder of police officer Triumf Riza, but according to the court, the handbinder has failed to find the address where Adelina Ismaili lives, while her telephone numbers are not available.

Justice Chief Shashivar Hoti announced at the beginning of the session that in the quality of the witness, Adelina Ismaili was heard.

The court has sent out an invitation, but by the delivery of mail, the court has been announced that the witness does not have a new address and phone numbers are not valid.

The court then asked the parties if they agree that witness statements by Adelina Ismajli will be considered read after a long time of development of judgment has been made.

Special Prosecutor Hakki Gegaj said the witness who had a hearing today is a very important witness.

From the subject paperwork I possess, she has issued statements to the police in the prosecutor, as well as issued a statement in the judicial examination of this criminal case. I know there's trouble with these switching addresses. I think if the defence and defendants agree, I would have agreed to read her statements that she gave to the previous stages of the criminal procedure”, prosecutor Gecaj said.

Kosovo lawyer Kelmendi declared she agrees with reading the witness's statement given in the past trial for the fact that during that trial the witness in question has also been clarified with her statements she gave in earlier stages.

So I would just beg the juro that, when reading the statements of this witness, only the circumstances regarding the point 1 of the indictment”, lawyer Kelmendi said.

In this regard, the Court made the decision and approved the prosecutor's requests that witness statements Adelina Ismili given in all phases of the procedure be considered read.

The court also indicated that four witnesses will be heard in the following hearings: Emma Ishmael, Genfine Ishmael, Besnik Hasani, and Shpend Qerim.

Indictee Enver Sekiraqa's lawyer, Kosovar Kelmendi, opposed that witness Shpend Qerim will be heard at the next hearings.

In earlier stages, I have opposed Besnik Hasani and Shpend Qerim, since early stages of standing up to the indictment. I propose that the Shpend Qerrim not be heard in the quality of the witness in this criminal case, because this witness as loyal as Hasani can't be an objective witness, not even under oath for the fact that they are persons who have tried to kill my accused Enver Sekiraqa, performing criminal work known to the explosion on Bill Clinton” Street, she said.

“Persons known for the five-fold murder, defense has doubts even in their credibility. The more this witness, the Shpend Qerim has no re-advisor at all with the object of the prosecution. The fact remains that in the previous trial, the international prosecutor in the absence of direct evidence has nevertheless tried to collect circumstantial fragments. But witnesses who have no cause or direct connection to the prosecution's item, which is at point 1 of the indictment, and the defence rejects this proposal for witness hearing”, said indictee Enver Sekirqa's lawyer.

Special Prosecutor Haki Gegaj in connection with the Kosovo lawyer's proposal, Kelmendi, said he has given the proposal for witnesses to be heard on this criminal issue and credibility and objectivity issues will be assessed by the court.

Judge Shashivar Hoti approved the special prosecutor's proposal that faithful Hasani and the Shpend Qerim be heard at the next hearings

Enver Sekiraqa is being tried on prosecution charges for inciting the murder of police by Kosovo Police Special Unit Trifif Riza. Sekiraqa in 2016 had been sentenced to 27 years in prison.

The case was turned into retrial after the Court of Appeals found it supported by the defence complaint, Kosovar Kelmendi.

Enver Sekiraqa is accused of inciting the murder of former police officer Triumf Riza.

For the murder of police officer Riza, Arben Berisha has been sentenced to 35 years in prison after he was found guilty in the charge of having killed Triumf Riza in 2007 in Pristina's ão Santea” neighbourhood.
