Court confirms the indictment to Paul Lekat for abuse of duty

In the establishment of the Gjakova Foundation Court, the request for the dropping of the indictment and rejection of evidence has also been rejected against the other accused of misusing the official position Ismet Isufi, as well as accused Veli Hajdaraga for fraud over subsidies and criminal acts avoid taxes.

Meanwhile, against that verdict by Judge Sacir Zika, disgruntled parties could file a 5-day complaint at the Court of Appeals.
The Special Prosecutor established the indictment in April 2018, claiming that these works were consumed at the time when Minister Lekaj was chairman of the Gjakova municipality.
Former head of Gjakova, Pal Lekaj along with Ismet Isufin, Easter Syla, Bekim Syla, Teuta Mayzin and Dafina Thaci are charged that acting as Gjakova municipality officials have misused their official positions during the distribution of subsidies.
On the other hand, Veli Hajdaraga is tasked with the work of subsidies and tax evasion.
In this case, the Court of Appeals, the case in which Minister Lekaj and 6 others were accused of misusing official duty, had turned him into a restoration for which work the Constitutional Court in Gjakova had confirmed the indictment.
As for the other act of embezzlement during the exercise of the official duty for which the Gjakova Court had dropped this actual point, Apel has confirmed the same.
Pal Lekaj along with Ismet Isupin, Easter Syla, Bekim Syla, Teuta Mayzin and Dafina Thaci are accused of misusing their official positions during the distribution of subsidies.
According to the indictment, Paul Lekaj and Ismet Isufi are charged that during 2008-2014, acting on the quality of official persons, the first in the quality of the Gjakova municipality chairman, while the second as director of the Directorate for Agriculture, have distributed subsidies through the company “U n NION-VL”, contrary to the Public Finance Management Law.
The indictment says that the decisions Paul Lekaj has made cover only the amount of 235,400 euros, while other decisions have no kind of legal base amounting to 631,671,82 euros.
The same ones, while being obliged to forward the distribution of subsidies to the end and to precision, have allowed over 40% of farmers not to accept any subsidies that have enabled business “U n NION-VL”, or other persons adopting property benefits that, in turn, have damaged the Gjakova Community budget worth 69,786,000 euros.
And defendant Veli Hajdaraga, in the quality of business leader “U n NION-VL” has provided incorrect information about the separation of subsidies, stating and signing that they have accepted subsidies of all people signed on forms on their accession.
The same with the aim of partially or entirely avoiding the payment of taxes, tariffs or other donations required by law, has presented false data concerning his business revenues, wealth or economic situation, declaring a circulation smaller than real one, resensibly avoiding taxes at many around 35.550.00 euros, the indictment said.
