The indictment of Mimoza Kusari-Lila withdraws

At Friday's session, Judge Misin Frangu indicated that the plaintiff's lawyer, Meshar Selimaj, had sent a parachute to the court on September 10th, through which he had demanded that the hearing be postponed for a different date, reports the “Justice Trust”.
Lawyer Selimaj presented it with reasoning that his client needed to travel to the United States of America (SHBA) due to medical treatment.
Lawyer Selimaj's proposal for postponement of the hearing was rejected by the indictee's authorised lawyer, Gzim Nushi, under which the lawyer Selimaj's reasons do not provide legal grounds for delaying judicial review.
“From reading the parachute, it is only the possibility of the plaintiff to travel to the US, and in no other evidence proves that it will indeed travel to the US. The lack of plaintiffs in the quality of the interjudgment doesn't present an obstacle to the continuation of the procedure, since the same has their authorisations who are properly invited to this review, and their absence has not reasoned at all”, said lawyer Nushi.
Nushi proposed to the court that, instead of postponing the session, it will bring about a decision with which the indictment in question will be considered withdrawn.
Under these circumstances, Judge Frangu took the stand for the withdrawal of the indictment against Mimoza Kusari-Lila, arguing that the representative of the prosecution side, the pre-emptive exercise on September 10, 2018, has not forwarded any medical documents to the US for medical treatment.
According to Judge Frangu, based on Article 438, 8 of the Law for Controversial Procedure (LPK), the side should require only one postponement of the session for the same reason.
Otherwise, the first time the plaintiff Selimaj had missed the argument that there was a medical treatment first in Kosovo, and then had travelled to the US, while the second absence had argued with the fact that there was a quality session of the chief prosecutor.
According to the indictment, Mimoza Kusari-Lila, in the quality of Gjakova municipality chairman, on January 31st 2016 at 11:00, on the TV show “Life in Kosovo” with journalist Gharra at Radio TV of Kosovo (RTK), held in Gjakova, calling for the prosecution's work as former director for Geodezi, Cadastre and Prona, without basing the plaintale.
