KMDLNj emphasises that Liebani is sentenced in Serbia with an irrefutable decision of a Court for criminal corruption and participation in an organised criminal group called “Customs Mafia”.
Having avoided suffering punishment by fleeing to Kosovo, Serbia has placed it on the international research list or on the Interpol List, where it finds itself today, now as the Court of Constitutional Court of Kosovo.
Laban, according to information available to KMDLNY, has received wages from Kosovo's budget during 2011, as employed by the Constitutional Court and Serbia's budget, as employed in Dogan, Serbia.
Kosovo's Constitutional Court has so far been extremely politicised where the selection of judges has been made, not on the basis of professional criteria, but on the basis of belonging and political prosecution, while, by illegal Z. Lieban, it is legalised to criminalise this Court or the culmination of Kosovo justice. Surprisingly, internationals have not reacted to this criminal decree and have been very vocal, rightly, against politicisation of this court”, the report said.
According to KMDLNj, the decree of Ljubljana as the Court of Kosovo Constitutional Court is political decree, which greatly damages Kosovo's reputation on the international plan by listing it among the countries, not that they do not fight corruption and organised crime, but stimulate it by appointing as judges persons with a clear past and criminal testimony.
Vice President Thaci has bought time to decree Lamba for the Court of Constitutional Court of Kosovo, and although it is clear that Laban, even if not on Interpol's Research List, does not meet any criteria for being elected to the post that he currently holds. High moral integrity, credibility, clean moral past, professional preparation are some of the criteria that must be met as preconditions for entering the close circle of the Kosovo Constitutional Court court”, said in response.
Lieban, according to KMDLNj, did not have to be decreed for the Court of Constitutional Court of Kosovo, but had to be investigated, arrested and convicted of forging documentation and legalisation of a real one which is easily documented (the court's decision of Serbia and the Interpol List).
KMDLNj also opposes the way candidates are recruited for the Court of Kosovo Constitutional Court, as well as the manner of interviewing by the panel that has no professional capacity to make the appropriate selection for the Constitutional Court.
“ ...That's why legal changes should be made that create an opportunity and other mechanism for election of the Constitutional Court judges, as well as that the president should have legal restrictions that he would not have the right to decree candidates with a criminal past, such as the case was Laban”, the KMDLNj reaction said.
