The newspaper Life in Kosovo has provided a document that the Minister of Infrastructure, Paul Lekaj has sent it to the secretary-general of the prime minister on April 20th of this year. The document, Lekaj called it a “Mnemorandation commentary on the contractor's request {Bechtel & Enkaʹ for compensation of indirect spending due to the extension of the contract's deadline for the construction of the R6 Pristina Khan of Elez” highway.

The contractor, in this case the company “Bechtel&Enka” has asked the Government of Kosovo 16 million and 600 thousand euros for indirect damage or expenditures for management personnel who managed the project.
While, 36m of 300 thousand euros “Bechtel & Enka” has asked the Government of Kosovo based on equipment usage. Two figures are mentioned on this expense. Initially it is a requirement for 30.8m euros, but in final calculations it is 36.3m euros. So the fact that the government will pay is 5.5m euros more.
Government payment delays for “Bechtel& Enka”
Bechtel & Enkaʹ has asked for another 10m euros for spending during interruptions and extensions, since they claim they had lost productivity for 2014, 2015, and 2016.
This contract was signed at the time of government Thaci II, on July 1, 2014, respectively, when the government was in office. During the implementation of this contract, the prime minister was Isa Mustafa (2015- 2017). In Thaci's time, the minister of Infrastructure was the one today who replaces Pal Lekaj, Fehmi Mujota, while in the time of Isa Mustafa, the minister was now LDK deputy Lutfi Zharku.
All these company demands, totally amounting to the cost of 63m euros, but according to Lekaj this amount has dropped after the negotiations. And negotiations do not seem to have lasted more than 18 days, as the agreement has been signed 18 days after the government's coming to power, Hardinaj.
Paul Lekaj in his letter shows that during negotiations, the amount has managed to drop to 45m euros without VAT. In total, this figure has amounted to 53m euros, counting T VV of 18%.
“In compensation for this amount has been reached to reconcile the contractor for giving up the demand for paying damages for payment delays for 2014-2018, as well as to pay the required sum in monthly installments for 12 months”, Lekaj's letter submitted to the prime minister's office.
Penalties because of these delays were also envisioned in the contract, where there were additional clauses for any possible delay.
This letter by Minister Lekaj says that to meet the creditor's delay, two conditions must be met: the first to have the debtor (Bechtel&Enka) offered execution of obligations while the lender (government) is delayed due to time saxing.
The second “condition, when the creditor (government) hinders with its behaviour the fulfillment of debitor obligations (Bechtel&Enkas). The second could be attributed to the delay of payments agreed to perform works by Government”, the memorandum's letter said.
Lekaj on his letter to the government says that based on the contract in case the case goes to Arbitrazh, Vienna, the review will be made based on the laws of England and Wales of Great Britain and not the applicable laws in our country. In his letter, Lekaj says the epilogue of Arbitrazhi is not sure, but does not say that Kosovo will eat up this case.
In documents provided by the newspaper Life in Kosovo, it is seen that during 2014, the Government of Kosovo has paid 55 million and 468 thousand and 528 euros and 85 cents (55,468,528.85. Euro), while it had to pay 70m euros. So it paid 14m of 531 thousand 471 euros (14,531,471 Euro) less or turned into a percentage, about 21 % less. The document, however, does not indicate whether things throughout the universe are stuck to this percentage.

During 2015, the Government of Kosovo paid 112 million and 124 thousand and 859 euros and 86 cents (112,124,859.86 Euro), while it had to pay over 107m euros more.

In 2016, 205m euros were planned to be paid, but the state had paid only 155m and 978m and 20 euro and 49 cents (155,978,020. 49 Euro)
Work done and unfinished at the Highway
The total length of the highway is 65.56km, while so far have been opened for communications and movement over 36km, while construction is over 28km of roads. Most of the unfinished jobs are in the hardest segment where construction of several bridges is envisioned.
This highway totals 19 bridges, with only 1 finished. 15 are under construction, while 3 are still under construction.
While the subpasses are 18, where 16 are complete, one is being built and another is yet to begin.
