The Anti-Corruption Agency is committed to raising Prime Minister Ramush Haradinaj's salary and his subordinates in conflict with interest even after the Kosovo Constitutional Court ruling.
In a response to KALLXO.com from the Anti-Corruption Agency have said they lag behind their decision.
The anti-corruption agency in line with the 1258/18 Constitutional Court of the Republic of Kosovo, point 113, respectively, lags behind its opinion, issued on the 2901.2018, regarding the No. 04/20 for the monthly pay assignment for specific categories of positions, including the establishment of the prime minister's salary -- deputy prime ministers, ministers, advisers -- and a category of civil servants of the Government of the Republic of Kosovo, on 20.12.2017.
Point 12 of the Constitutional Court's ruling estimates it is not in the competency of the Constitutional Court to assess whether the decision conflicts with the Conflict of Interest are at odds and that the Agency Against Corruption has already suggested.
Furthermore, the AKK warns that we will take the necessary legal actions, and here under the Law, neither criminal denouncing against responsible persons is excluded.
Paragraph 3 of Article 24 of the Law for Prevention of Conflict of Interest in Action in Kosovo envisions cases of criminal speculation.
“Agentia, every official, official leader and every institution exercises criminal speculation at the state prosecutor competent to the official who violates the pre-priced obligations to this law, which constitutes criminal acts under the Criminal Code of the Republic of Kosovo”, the law stipulates.
The Anti-Corruption Agency, with the opinion of January 19th 2018, had found the situation of the conflict of interest in the decision to raise the prime minister's salary and some of its subordinates.
After that, this decision was suspended by the Kosovo government, to re-enforce the Constitutional Court's decision that the decision did not conflict with the Constitution of the Republic.
However, as the AKK quoted, the Constitutional decision had not addressed the issue of conflict of interest.
The Constitutional Court's decision has also benefited members of this court.
