Rama Arta is opposing the election as head of the Constitutional Court. Former judges and judges in this institution have told the paper that it has secured the second mandate in disparity with the Court's Constitution of Labour, since it has been the only candidate in the race, Koha Ditore writes today.
They have shown that the 10th Rule of Order, under which Rama is elected, contains identical requests like Article 5 of the Article 85 of the Constitution, referring to the election of president of state.
In the case of Behgjet Pacolli's election to president, the Constitution in an act had made it clear that the procedure with only one candidate constituted violations. To that end, but also because of the fact that it was considered not to have been quorum in that process, Pacolli's choice had been declared unconstitutional.
