At the Constitutional Court in Pristina in retrial of clinic doctors “Medicus”, Lutfi Dervisit, who is accused of trafficking with human beings and organised crime, as well as Sokol Hajdin, accused of serious bodily injury, is now expected to be declared a judicial act.
During the last session, the final word has been given to the defence parties, who have once again rejected the indictment filed by the Prosecutor.
Lutfi Dervisi's defender, lawyer Valon Hasani, has said that the prosecution with no evidence has testified that his client committed any criminal act, since, according to him, Dervis is not a traffickers and has not been part of any criminal group, so he has asked the tribunal to release him from the same charge.
While Sokol Hajdin's defender, lawyer Rame Gashi, had stated that the criminal act his client is charged with is deliberately and deliberately caused to cause any bodily injury, but that according to the lawyer, the Prosecutor has failed to prove that Heidi committed any element of this criminal act.
And accused Lutfi Dervisi has said that kidney transplanting is human, not criminal, because according to him worldwide, thousands of transplants, but no one is prosecuted for it, writes Kalxo.com.
Even Sokol Hajdini has denied the charge in his direction, claiming that he never went against the law in his work and that he never worked to cause bodily harm to anyone.
But case prosecutor Valeria Bolic, in the final address, has asked the Court to confirm Dervis and Sokoli's criminal responsibility and punish them according to legal limits.
During his defense, Lutfi Dervisi had declared that the clinic “Medicus” had permission for kidney transplantation and that, according to his knowledge, only one operation had been performed in this clinic, in which he also claimed to have participated.
And anesthesiologist Sokol Hajdini was quietly protected.
Lutfi Dervisi, owner of the Clinic “Medicus” in which the Prosecutor's Office is allegedly having kidney transplantation, is accused of trafficking with human beings and organised crime, while Sokol Hajdini is accused of serious bodily injury.
Part of that judgment was Arba Dervishi, the son of Lutfi Dervis, but the procedure against him is isolated because he is on the run.
Urologist Lutfi Dervisi had been sentenced by the Constitutional Court in Pristina to eight years in prison in 2013, while Sokol Hajdini to 3 years.
The Court of Appeals had later confirmed Dervis's sentence, while Heidi had added her years to her prison sentence from three years to 5.
