The decision-making process and implementation of procedures in the case of deportation of Turkish citizens is being investigated by the Ombudsman's Institute.
The deportation of six Turkish citizens brought many discussions, saying international standards and human rights were also violated. After that, the ombudsman's institution launched investigations into the insights made by state institutions.
Indexline has contacted the ombudsman's office, who have indicated they have already begun investigations and are in the phase of collecting intelligence information. According to them, the decision-making process and implementation procedures by responsible authorities are also being investigated.
Furthermore, they have underlined that one is contrary to international standards and human rights.
“The actions undertaken by public authorities regarding the arrest and deportation of six Turkish citizens from the territory of the Republic of Kosovo are contrary to international standards for human rights and freedoms, applicable to the internal judicial system of the Republic of Kosovo, and this is considered one of the worst violations related to protection from mistreatment, humiliation, treatment of inhumanity and degradation, defined with Article 3 of the European Convention “, says the Office for Information of the Ombudsman.
According to officials of this institution, no one can deny the possibility of a state to deport its citizen, but this is done in line with the procedural steps guaranteed by law decisions.
No state can deny the possibility of deportation or extradite a person, but this cannot be done without forwarding procedure guaranteed by laws and international decisions on human rights. In concrete cases, obligations and actions that can and should undertake competent organs have not been followed. Thus outcasts denied the right to be heard and judged by the competent public body. This right is also guaranteed with the Constitution of the Republic of Kosovo, the Universal Declaration for Human Rights, the European Convention for the Rights and Freedoms and its additional Protocols, the Civil and Political Rights Pact, and the ECHR judicial practice. All these international instruments are part of the constitution and law of the Republic of Kosovo and have priority over local provisions and laws in case of conflict. ” says in their response.
While finding out about the case will soon be published with the “report. Ex surplusio”
