The prosecution and police wrong the business name where a crime was committed

A research has found that Pristina Prosecutor and Police have missed the exact address of a country where a crime was committed, presenting a crime scene that does not exist in Kosovo at all.

In January 2017, a gunshot wound had occurred at one of Pristina's locals.

And in police and Prosecutor's files the event has been shown to have happened in a business that is not registered at ARBK and that doesn't exist by that name on that road.

In January 2017 at Club “Marion pub” there was an injury.

A security worker was injured on the morning of January 20th following a disagreement.

Events further show that Kosovo police in all of its documentation had avoided the original business name using the name “Moron”, not the business name where the event occurred.

KA LLXO.com noted that the first mistake was made in the police's criminal connoisseur.

Asked about this mistake, Kosovo Police officials have declined to provide clarifications for the motive that has prompted the police to remove a “O” from the criminal outcry.

Errors in describing the scene have also been followed in the state prosecutor's indictment.

In the Pristina Prosecutor's Act, the prosecutor attempts in two cases to describe the business name but in both cases by mistake.

Technical or spelling errors have often prolonged the judicial process.

These mistakes have not only prolonged the judicial process, but in one case they have even turned it into retrial.

It's about the trial process called “Harausham”, the latter according to the terrorist organisation, which later came to be the organisation “Ahral Al Sham”.

This case, which even became known in the media as the “Harausham”, because of the prosecutor's mistake that in the indictment, they claimed that the accused had joined an organization for which BIRN actually found that he did not exist.

Initially, the two indictees of this case -- Necjat Behluli and Arben Livoreka -- had pleaded guilty and had been sentenced in total of 42 months in prison, but later during the trial review at the Court of Appeals had refused admission of guilt.

Lawyer Hedije Ademi, defender of the accused Nexhat Behluli had communicated to the tribunal that until the withdrawal of guilty plea has come after investigating journalists who had concluded that the organisation “Harausham” is not a terrorist organisation.

“A research into journalists who have researched and made sure that the organisation Harausham is not a terrorist organisation, so the Court of Appeals proposes that they change the criminal sanctions against my defenders or the subject turn it into retrial”, Ademi lawyer had said.

If it proves that the organisation "Harausham" actually does not exist, it would be very bad because it means innocent people have been convicted. Always if proven no exist, we will address the Supreme Court of Kosovo”, Ademi said.

The Court of Appeals later turned the case into retrial because of a series of violations.

The term “Harausham”, which was referred to as an inaction terrorist organisation, was subsequently improved by the Special Prosecutor.

The special prosecutor of the case had reasoned with the fact that the name “Harausham” is translated from English from the list of terrorist organisations.

Nearly four years have required Kosovo's Special Prosecutor to improve this error in the indictment, which charged two persons with participating in the Syrian war.

Returning the case to the retrial from 42 months in total prison cost Arben Livoreka only two years in prison on bail, meanwhile for Nahjat Behlulin, the special prosecutor withdrew from the prosecution.
