NISMA LEGISTIV E FOR COMISIONET JEIMAL PARLAMENTAR
Investigation commissions are among the most important instruments for parliamentary control of government institutions, as well as agencies stemming from the Parliament of the Republic of Kosovo.
Therefore, with the support of MPs from the Independent MP Group, I have prosecuted the Legislative Initiative: The draft law on Change and Fulfilling the Law on Parliamentary Investment, that the bill fulfills all formal aspects.and proceed to the head of the Assembly of the Republic of Kosovo.
With this bill we intend to eliminate certain procedural aspects:
The parliamentary groups were set short term for sending the commission members' nominations. In that sense, we have considered the 7-day deadline sufficient.
In the past, investigative commissions have failed to be established because the general status-opposital difference has been one more. With the new bill, however, the practice is intended to change. The new bill changes the general members to the opposition-posital report in the Assembly puts one more member by the opposition. Thus, in no way would parliamentary groups in government be able to block the investigative commissions.
Another change, will be the appointment of the Chiefs and vices. Commission chairman. We consider the leader to be elected from among the parliamentary group, which is initiator of the Parliamentary Commission. While the deputy chairman should be named by the Parliamentary Group's proposal, which is co-initiator of establishing the commission, the parliamentary group, which is part of the signatures on the initiative list.
A positive change will also be the final report. With basic law, after the report was adopted, the report remained in the drawer of the Parliament. While, under the new law, the recommended report in the Assembly is sent to the Government of Kosovo, relevant ministries, the president, and the Ombudsman Institution.
The report adopted in the Assembly, along with recommendations, is sent to the State Prosecutor for taking further measures.
The State Prosecutor informs the Assembly of the conduct of the investigation on cases recommended for the investigation.
As an MP, and as a parliamentary group, we are open to all who have an interest in helping amend this bill after passing in principle.
