The initial session was postponed to hold this Monday, to the former mayor of Prizren's municipality, Ramadan Muja and former officials of this municipality, Minr Krasniqi, Sadik paziazi, Avni Ademiaj of Abdullah Yorci, accused of misusing the official position.
Due to the postponement of this hearing, there was a shortage of Judge Agim Ademi.
Regarding the absence of Judge Ademi, his legal official, for the “Justice Trust”, announced that the judge is in Pristina, because, as he said, he has had an interview with the Kosovo Judicial Council regarding the process for selection of the Chairman of the Foundation Court in Gjilan.
However, he said all sides have been announced in time for failing to hold this court hearing.
The next session of former Mayor Muja and others is expected to continue tomorrow, March 20, 2018, at 10:00.
Otherwise, the Special Prosecutor in February 2013 has filed charges against the former mayor of Prizren, Ramadan Muja, former director of the Directorate for Urbanism and Spatial Planning, Sadik Laziz and former Geodez and Kadastry Director Avni Ademiaj.
In the indictment filed for abuse of official office were former Prizren municipality officials Abdullah Toreci, Miner Krasniqi and Kadri Ukimer included.
The muja and others are accused by the prosecution of misusing municipal properties managed by the Kosovo Privatisation Agency as well as among the properties are two parcels where schools “Mehmet Akif” and the chocolate factory “Kamila” in Prizren, which, according to the indictment, have not been passed through the Comunal Assembly but with the direct decision of former Mayor Muja.
On March 13th 2014, following about 30 court hearings, the Constitutional Court in Prizren, has declared a condemnation of former Mayor Muja and others.
Muja had been sentenced to two years in prison, provided she did not commit criminal acts for the period of three years. The muja had also been pronounced the supplementary punishment of stopping the operation of office in public administration for 30 months.
The Constitutional Court in Prizren had declared a condemned trial even against the other indictees in this case, paziarizi, Ademiaj, Tireci, Krasniqi and Ukimer, also being banned from their post in public administration for certain periods of time.
The Court of Appeals had annulled such a decision and turned the case into retrial, but by prosecution the case went to the Supreme Court, where the Supreme Court had later decided that the subject would re-evaluate Apel.
The appeal again in July 2017 has decided that the subject will return to the first degree for reexamination and re-institution, but the Foundation Court in Prizren has demanded that the case be excluded.
Such a plea was made with the reasoning that one of the acts that Ramadan Muja is accused of is a criminal prosecution introduced by the Constitutional Court in Prizren for obstructing work in court, in the case of stopping experts from participating in geodesencies in court hearings, where the court president and a judge have been heard as witnesses.
The Court of Appeals, following a request made by Prizren Foundation Court Chairman Ymer Hoxha on August 8th of this year, had decided that retrial against Ramadan Muja and five other indictees be held by the Constitutional Court in Gjilan.
So Kadri Wikimer has stopped criminal proceedings since the same man passed away. /Betimitor Directorate
